Gov. Tom Wolf: Pennsylvania Will Not Take Medical Marijuana User’s Guns

Pennsylvania is struggling with the legalization of medical marijuana and the Federal prohibition of marijuana use.

The state police have quoted federal law as prohibiting people who legally use marijuana under state law, from purchasing firearms under federal law. Medical marijuana users may be denied a Pennsylvania license to carry firearms.

PA will not take the guns of people with medical marijuana cards. But they are breaking federal law, and are on a state database.

I have whiplash.

Per the Constitution, the right to keep and bear arms shall not be infringed.
But states (like PA) take it upon themselves to infringe it.

Per federal law, marijuana is just flat-out illegal.
But states (like PA) take it upon themselves to make it legal.

But then states have a dog-and-pony show about how federal marijuana laws may require them to further infringe firearms.

I think they’re just doing whatever they want to do.

Remember when the libs were all gung ho about setting the federal government against gun owners? Well, that’s exactly how I feel about the state marijuana laws. I want this to hurt.

Yeppers... pretty soon it will be discovered that second hand marijuana is actually GOOD for you, so smoking in restaurants, baseball stadiums, bars and such will be OK... The libs will even bring back smoke breaks for high school kids... It's all good now...as long as it ain't tobacco...

This is what happens when a lib takes over.

Progressivism can’t exist in the same time and place as the Constitution. They are power hungry, and power glutton. When they are elected, they say things like “my state” and “my seat” and they declare that they are in charge.

Per the Constitution, a rule book that gives instruction to the Government, not the people...
But states (Like PA, CA, CT, RI, NJ, NY, MA, etc) take it upon themselves to rule like they are kings, and not citizens given a job to enforce the rules (Which since they are written for the Government the enforcement of rules happens in the halls of government)

This the State Police miffed about the change in the law. Union members pouting. They should be reminded that they don’t work for the Federal Government.

Once again we have a Democrat chief executive suggesting the Law isn’t what it says, and won’t be enforced. The PSP has a checkered record on guns — chiefly they maintain an illegal gun registry. They do this by making the Monte Python argument that “it isn’t a gun registry” when it’s obvious that it is just that. Nevertheless, an agency like the PSP isn’t going to post a statement like this on their website without having their own legal counsel give their approval. Then our brain-dead governor, in total reaction mode, says, “yeah..... We’re not going to enforce that!”

Per the Constitution, federal law is irrelevant here and the state can do what it wants.

I won’t disagree.

But the key thing, I think, is the 10th Amendment. There are certain things that the federal government controls — or prevents others from restricting. And there are certain things over which the federal government should have no say — and that is left to the several states.

But I think the lines got blurry and now the Feds are in and out in areas where they feel like getting involved and the states don’t matter.

I’d like a re-assertion of the 10th, and I’d like a MUCH smaller and weaker federal government.
