Bill applies felony charge to owners of dogs that maim or kill

Legislation moving through the Alabama State House would make owners of dogs who injure or kill people subject to felony charges.

The bill is named after Emily Colvin, who was attacked and killed by five dogs in front of her home in Section in Jackson County in December. Colvin was 24.

Five members of Colvin's family were on hand today when House and Senate committees approved the bill, which is sponsored in the House by Rep. Nathaniel Ledbetter, R-Rainsville. Ledbetter said the attack on Colvin happened a few miles from his home. Sen. Steve Livingston, R-Scottsboro, is the Senate sponsor.

The attack on Colvin followed the death of Tracey Patterson Cornelius, 46, in Guntersville in November, also the result of an attack by dogs. Another woman was seriously injured by the dogs who killed Cornelius.

"We've lost two lives in north Alabama in the last couple of months due to dangerous dog attacks," Ledbetter said.

Barry Matson, executive director of the Alabama District Attorneys Association, said the bill also adds a civil remedy for dealing with dangerous dogs.

If there is probable cause to believe that a dog has injured or killed a person without provocation, a law enforcement or animal control officer would impound the dog. A county attorney or city attorney could then petition the district court or municipal court to declare the dog dangerous. The owner of the dog would be responsible for the cost of care while the dog is impounded.

Pit bulls and Chows perhaps? I know some think pit bulls are great, but I have seen too many instances where someone’s “baby” suddenly turned on them. The problem with pit bulls is they are completely unpredictable. Chows are just dumb and mean. If you don’t believe me about Chows being dumb, look where they fall on the doggie intelligence ratings.

Every time I look at the shelter dogs in our area, virtually every one of them is either a pit bull or part pit bull. Why are people so crazy about these dogs? Is that the only kind of dog that breeds these days? Or is it just those are the ones that nobody wants to adopt?

I would love to have another black Lab like the one we had for many years, but we can’t have a dog where we live. I still miss that dog so much. :-(

I don’t believe shelters should allow people to adopt or give out pit bulls. They know nothing of the previous owners and how it was raised.

If crazy people want to pay for crazy dogs, they need to accept the risk. The risk if pit bulls are unpredictable. If they’re confident their dogs are so good, they should have no problems with the new law.

If I misunderstood your reply to me. I am very sorry for my reply.

I’ve seen some people get very defensive about pit bulls on here and I thought you must be one of them with the reply. Again, I apologize if I misunderstood.

Did it ever occur that the post was to you because he responded to the article you posted and that's the just the way it works?

Sometimes I think we hit the post button a little to soon, I know I do, and it would be awesome to have an edit feature. As in looking at my post to you, I could have phrased things better.

I am sorry but it did not occur to me that his post was directed at the article.

For the record, I am a peace loving non-violent person. But, truthfully, I don’t know how I would respond if a child or other family member was killed or maimed by an irresponsible dog owner.

Yes. I wish I had an edit feature or in this case, I’d been better off with a delete feature.

I appreciate you pointing out my misunderstanding. And even if the reply to me was as I had first thought, my reply went too far.

Does it apply to dogs that attack a person that has burglarized your home? I can understand pressing charges if the person was not committing a crime against the owner's person or property.

Owners should be held accountable for their dogs. For noise, for crapping and for safety issues. I despise the hordes of inconsiderate and irresponsible dog owners.

But clearly that accountability should not and cannot be breed specific.

But why have a rational discussion when we can turn this, like every other dog thread, into a pit bull bash fest? While forgetting the original post of the post. With the usual predictable results.

I don’t insult people here and I don’t make ad hominum attacks. If anyone wants to do that to me, I suggest you go hang out with liberals where that is considered classy behavior. I like to think FReepers are several cuts above the liberal mouth breathers, please don’t prove me wrong.
