Todd Howe, the prosecutions star witness against Joseph Percoco, was arrested Thursday night after admitting in court that he likely had violated his cooperation deal with the feds, a source told The Post.
Howe was remanded back to custody for violating the terms of his bail, said Nicholas Biase with the Manhattan US Attorneys Office.
Asked if Howe who is being held at the Metropolitan Correctional Center in Lower Manhattan will still testify Monday in the corruption trial, the US Attorneys Office declined comment.
Under cross-examination Thursday, the longtime associate of Gov. Cuomo admitted he lied to his credit-card company in the fall of 2016 after signing an agreement with the government that required him to avoid committing future crimes.
Howe admitted that in October 2016, he asked his credit card company to refund $604.86 in charges from a stay at the Waldorf Astoria, suggesting he hadnt stayed there.
His stunning testimony came on the second day of his blistering cross-examination at the corruption trial of Percoco, who Howe claims to have helped obtain $300,000 in bribes.
Howe said he canceled the charge for the hotel stay amid a series of nine sit-downs with authorities investigating Percocos alleged pay-to-play scheme involving companies doing business with the state.
The former lobbyist also conceded that the questioning in Manhattan federal court forced him to realize he had violated the terms of his cooperation agreement with the feds.
Under his deal, prosecutors agreed to seek leniency for Howe when hes sentenced for eight felonies but only if he told them about all his offenses and didnt commit more.
