I believe this is precisely why the announcement about the delay in Flynn's sentencing was made within 1-2 days of the release of the Nunes/HPSCI memo.
My suspicion - One of the few Democrats who actually viewed the memo ran straight to him after reading it and told him to put it on hold.

Fascinating article. Rare example of a reporter doing real research to add to the public knowledge of a topic. Also that comment is fascinating if true (ie that Weissman was the Stevens prosecutor).

My one quibble with the article is:

I have been wondering why, shortly after Judge Rudolph Contreras was (without explanation) recused from hearing the Michael Flynn case and Judge Emmet G. Sullivan took over, Special Counsel Robert Mueller agreed to postpone the sentencing until May, after the inspector general’s report is due.

where “shortly after” is almost two months later.

If Flynn’s case is dismissed without predjudice that leaves Mannafort and Papadopoulos.

I think Mannafort is cooked. He looks like he was moving money around and hiding it from the IRS, but this is stuff that happened years before he got on the Trump campaign team.

Papadopoulos lied to prosecutors also and he may be cooked. However, he was a low level advisor who the press admits was trying to arrange a meeting between Putin’s people and Trumps people and was rebuffed time and again.

Given the above facts as truth, where exactly does that leave us with this investigation? Where is there any sign of Russian collusion or any crime whatsoever? The press called the Nunes memo a big nothingburger, no this investigation is a big nothingburger with cheese and pickles on it!!!

Clarice Feldman seems to think the prosecutor can “dismiss” a case for which there has already been a conviction. Judge Sullivan’s request is for exculpatory information he wants to consider before sentencing. In this case, that might be material about Flynn’s long, exemplary career, the relative nothingness of the transgression, or it could be whether he cooperated, i.e., ratted out others to the Inquisition, as promised?”

Among the many things that bug me is Item 2 of the Statement of Offense attached to Flynn’s plea, wherein the Mueller group claims Flynn’s misstatements “impeded or otherwise had a material impact on the [...investigation of Russia’s efforts to interfere with the 2016 presidential election]”. That is a howling lie. Flynn’s denials of making certain statements to the Russian Amb. during the transition, about subjects that had nothing to do with the election, had no impact whatsoever on the FBI’s investigation of Russian interference in the election. The FBI possessed transcripts of Flynn’s calls before asking Flynn the questions. It was irrelevant to the “election interference investigation” whether Flynn admitted or denied these calls. The Special Prosecutor’s justification to the court for why the whole case mattered, was utterly false — it didn’t matter one whit. An admission of that lie is the “exculpatory” information Mueller should turn over — but of course will not.

Re: Mueller will dismiss against Flynn

That’s a really interesting, well reasoned, and really bold prediction.

I hope it happens.

Next on the list - that drunkard nobody George Papadopoulos, who also pleaded guilty to lying to the FBI.

George P. has already made one more bad mistake.

He let his girlfriend publicly claim that “heads are going to roll” when George P. testifies.

In case Mueller decides not to dismiss against George P., which is possible since George P. told a blatant material lie, Trump will not lift a finger to help him.

He is an article regarding the dismissal of the Senator Ted Stevens conviction. Judge Emmet Sullivan is not going to let Mueller skate on violations of Flynn’s constitutional rights. Sullivan is going to rip him a new one.

Put on your tin foil hats gents.

The whole Fylnn investigation was a ruse, slight of hand. Comey told Congress during a hearing that Flynn had not lied and the FBI did not recommend any action be taken. Mueller charged him. Flynn has been busy digging exposing deep state thugs shhhhh

Judge Sullivan’s request is for exculpatory information he wants to consider before sentencing.

Judge Sullivan's DEMAND for all the evidence has nothing to do with Flynn's sentencing. Sullivan is going to vacate the conviction. This is about holding Mueller accountable and ripping Mueller a new asshole. Mueller may try to send one of his flunkies to the hearing, but I suspect Judge Sullivan is going to insist that Mueller show up himself for the ass-chewing.

They [the prosecutors] are compelled immediately to turn over all exculpatory material in their possession to General Flynn.
As officers of the court, weren't they already required to do that before getting a specific order to do so?

IANAL but couldn't the prosecution move to have the guilty plea vacated?

Judge Sullivan’s request is for exculpatory information he wants to consider before sentencing.

Would that not include revealing any misconduct on the part of the prosecutors?
