DNC Refused To Comply With Dossier-Related Subpoena, So BuzzFeed Sued

BuzzFeed News sued the Democratic National Committee (DNC) Tuesday to force the release of information that the news outlet hopes will help it defend against a lawsuit related to the Steele dossier.

BuzzFeed is seeking digital information that could shed light on the cyber attacks against the DNC during the presidential campaign.

The news outlet faces three separate lawsuits related to its publication of the dossier, which was written by former British spy Christopher Steele and financed by the Clinton campaign and DNC.

The suit against the DNC seeks information that could help defend against a defamation lawsuit filed by Aleksej Gubarev, a Russian tech executive accused in the dossier of using his web hosting companies to hack into the DNC’s computer systems.

Gubarev denies the allegations and has argued that BuzzFeed failed to verify the dossier before publishing the report in January 2017. Steele, a former MI6 officer, has acknowledged in a London court, where he is being sued by Gubarev, that the information about the tech executive had not been verified.

“As part of the discovery process, BuzzFeed is attempting to verify claims in the dossier that relate to the hacking of the DNC,” BuzzFeed spokesman Matt Mittenhal said in a statement. “We’re asking a federal court to force the DNC to follow the law and allow BuzzFeed to fully defend its First Amendment rights.”

BuzzFeed filed the suit after the DNC refused to comply with a subpoena that the website issued in November.

The short answer is yes you can.

The long answer is that you have to makes sure the request is not unduly burdensome, which is probably why the DNC is framing their response the way they are.

So what are the lessons learned? Before filing a motion to compel document production against a subpoenaed non-party, make sure to request documents from the party before moving to compel, and more importantly, perform diligence to ensure you don’t already have what you’re asking for.

So better buy some popcorn and get ready for the hearing!

That follows “suit”...as such you have to issue a warning letter before you sue a person or company. I did it...you send a certified letter stating exactly the situation, so when the judge reads it at the potential trial there are no doubts of the situation.

Indeed, veeery interesting, since the basic issue in the whole “Russians hacked the DNC computers” matter is whether the purloined materials were obtained through a hack or a leak, and the current best evidence is they were leaked by a DNC insider, possibly the late Seth Rich.

Exactly...I had two representatives at a company both tell me I was wrong when I told them I can prove they owed me money. So I sent the letter...got nothing in return, then filed all the paperwork. I learned that you can’t sue a company in small claims court because a lawyer will be involved. Had to go to District court which is pretty much the same, but NO lawyers in small claims court (i.e. judge Judy), and you have to petition the registered agent of the company in the state where it’s incorporated.

Since I am pretty sure the DNC does not have real evidence of a “hack” I think if they present any evidence it will be the ODNI “assessment” that Russia interfered in 2006, and related statements from Pompeo, Coats, and Wray saying they believe the Russia nonsense.
