Byron York: An unusual turn in the Michael Flynn case?

Observers are buzzing about a series of events in the last 60 days in the case of Michael Flynn, the Trump national security adviser who on Dec. 1 pleaded guilty to one count of lying to the FBI in the Trump-Russia investigation...

....On Dec. 12, after just a few days on the Flynn case, Sullivan, acting on his own, ordered the office of special counsel Robert Mueller "to produce to [Flynn] in a timely manner — including during plea negotiations — any evidence in its possession that is favorable to defendant and material either to defendant's guilt or punishment."

Sullivan also ordered Mueller "to produce all discoverable evidence in a readily usable form." And he declared that "if the government has identified any information which is favorable to the defendant but which the government believes not to be material, the government shall submit such information to the Court for in camera review." In other words, Sullivan declared that he, not Mueller, would be the judge of what evidence should be produced.

Mueller's deception is unraveling, may it be followed by a second special prosecutor to investigate Uranium One and his criminality....

Judge Sullivan got burned once by Federal Prosecutors withholding evidence and destroying lives. He won’t let that happen again.

Wrong date on article. It’s Feb 15 not 20 and there’s been another possible significant development (Sullivan revising his order) in the meantime.

Strozk oversaw the interviews with Flynn. McCabe supposedly changed agents’ 302 interview records & that is why Wray fired him. The FBI cannot provide a *clean* history of revisions for the 302 interview with General Flynn. Judge Sullivan has a reputation for & track record of exposing/dealing with dishonest DOJ/government prosecutors .... he’ll get to the bottom of it.

Mueller has a whole platoon of dirty (and agendanista) prosecutors that he recruited. I’m surprised he didn’t try to recruit the dirty prosecutor Reyna from Waco. Reyna would have fit right in.

Judge Sullivan would be insane to agree to Mueller’s proposed order (sealing all the evidence and preventing any of it from being used in any other proceeding). Hopefully he will deny the petition and tell Mueller to submit all data as ordered, when ordered, or be held in contempt of court. Mueller can petition to have all or part of it sealed after the Judge reviews it.

As a hypothetical example, what if the exculpatory evidence includes proof that McCabe falsified Strzok’s 302s from interviews with Flynn? If Sullivan agrees to the order, that evidence could not be used against McCabe. Nice try by the Swamp Lords.

If only. If only Flynn is completely exonerated. If only the judge finds out, who in the DOJ decided to go forward with this sham, against the advice of the FBI and put their a$$ in prison. If only the judge uses this to open up a can of whoopass on Mueller and his sham investigation and starts initiating, disbarment proceedings against all of them and has them reimburse the taxpayer out of their personal accounts. If only, the judge forces those responsible to make a public apology and allocution, explaining what they did, why the did it, what they hoped to gain from it and who ordered the unmasking.

If only, after all of that, President Trump tells McMaster to pack his sh*t, bring Flynn back with one mandate and one mandate only, Unleash Holy F*cking Hell on all of them. The kind of hell that would make Maximus and Ragnar Lothbruk, get queasy. And put each and every one of them in prison or make them go to Ft Marcy park to end it.

Prosecutors and the defense submitted to Sullivan a proposed order limiting the use of any new evidence produced by the government. The evidence can be used by Flynn's defense "solely in connection with the defense of this case, and for no other purpose, and in connection with no other proceeding." The proposed order, awaiting Sullivan's approval, also set out rules for handling "sensitive" materials.

Not sure why Flynn's lawyers would agree to this. If Flynn tries to sue McCabe for prosecutorial misconduct he won't be able to use this evidence.

I can’t stand Mueller. But, I’m wondering if this deception was carried out by Wiseman and Rosenstein and Mueller just took their word for it. How Wiseman isn’t in prison is beyond me. He must have the goods on all sorts of people.

What you say is right, but very disturbing.

I know it’s not our fault, but why are we even mentioning words like: exposing/dealing with dishonest DOJ/government prosecutors

If they’re dirty lawyers, why are they still lawyers for the people, if not in prison? Every day we learn more and more about the level of corruption in our government and it continues to get worse and worse.

It looks like the Federal Prosecutor team headed by Mueller have set up the makings of a kangaroo court. This is something you see in a dictatorship. The conviction of 22-year-old Otto Warmbier in North Korea, for taking a political campaign sign, come to mind.

Because, deep down they’re buddies with Mueller and his peeps. They’ll get Flynn off. Have a very nice feather in their cap. Be able to raise their hourly rates thru the roof, when, the only reason they’re going to be able to do that, is because the new judge doens’t put up with any crap. And their buddies on the other side, will get away, unscathed to live another day, like Wiseman has.

Otherwise, Flynn would be a convicted felon, collecting a military pension.

If evidence can be sealed, it can be unsealed. Sure, it might be more difficult to get to it, but not impossible.
