Supreme Court OKs Broad Immigrant Detention Powers
Daily Caller ^ | 2/27/2018 | Kevin Daley

Immigrants detained for removal proceedings may be held indefinitely and are not entitled to a bail hearing, the Supreme Court ruled Tuesday.

The ruling means that immigrant detainees, who are sometimes held for months and years on end, have no recourse to challenge their confinement.

Justice Samuel Alito delivered the opinion for the court, joined by Chief Justice John Roberts and Justice Anthony Kennedy. Justices Clarence Thomas and Neil Gorsuch joined most of Alito’s opinion, though they also wrote to say they do not believe the court had jurisdiction to hear the case.

Perhaps such a positive ruling for the Trump administration indicates that the request for immediate ruling on the DACA was put before one judge to decide?

I agree, politics is unsuitable to litigate in the U.S judicial system. Even here some Scotus Judges indicate that they shouldnt’ have even been involved.

If they do not fight their deportation they can get out of jail very fast, back in their country of origin that is.

When/if they tire of detention...they can request immediate deportation and regain their freedom.

Nobody is stopping them from making that simple request.

In fact, if we capture enough, and the deport judges are too few...when the camps have 10’s of thousands...they’ll request deportation in huge numbers.

Oh, and that’s another place we’re screwing up. The “holding facilities” must be tent cities...no matter the weather. The food on the legal side of marginal and no schools or day care.

No exit to the US proper without a green card.

Ever.

The federal govt scotus sure has jurisdiction to hear this case as immigration laws are federal laws and illegal aliens are breaking federal law, regardless of what leo agency detains them.

Jeebus what the hell is he thinking?

Makes me nervous... cracks open the door for such detentions to be used against others as well.

Not for citizens, but it could be for legal visitors.

I would imagine the two conservative justices dissented simply due to the fact that it is intuitively obvious these people are not citizens and are here illegally and that the Constitution gives complete power to the President alone.

The 5-3 decision overturns a sweeping ruling from the San Francisco-based 9th U.S. Circuit Court of Appeals that guaranteed a hearing to any immigrant with a pending deportation case. Significantly, the appeals court ruled that burden fell on the government to demonstrate that the immigrant was a danger or a risk to flee.

Another 9th Circus decision tossed. When is Trump and/or Congress going to spit this insane of all circuit courts in two?

Can exception yet be made for a party who claims to be able to prove either legal citizenship or legal presence? If not, we’ve only incurred another kind of lose rather than a win.

It’s ILLEGAL detainees, not “immigrant” detainees, Kevin Daley.

Quite right.

As an old newspaperman, I’ve seen some bad leads, of course.

But it’s a rare thing to read a story that blows its credibility with the very first word.

However, after forcing myself to read beyond the ignorance, this is good news.

Yes! Maybe this will encourage immigrants from gaming the system. I’m tired of my country being perceived as nothing more than some giant Motel 6 for the whole world. I work in a large hospital and virtually the entire staff, even the doctors are foreigners. A couple of women in my department, one Greek and one Polish have CNN all the time and hate Trump. One told me how socialized medicine is working so great in Europe. I said “Then why did you leave?’’. She has since stopped talking to me.

Why are they detaining these IMMIGRANTS?????? This travesty of justice should stop NOW.

I want illegal law breaking grass crawling border crossing aliens that are caught DETAINED and NO catch and release practiced. Furthermore, any FOREIGNERS who committed overstays on their visas should be rounded up and DETAINED and not released after being found.

Quit picking on the law abiding IMMIGRANTS you fools /now the s tag
