I’ve litigated hundreds of breach of contract claims. In most cases, the party that intends to breach — or doesn’t think what they’re doing is a breach — goes ahead and does it and waits to get sued. It is almost always, or at the very least, usually, better to be a defendant in a contract case.
RESIST is now a cottage industry.
