Australia: NSW Supreme Court Decision a Disaster for Gun Owners In 2017, when I visited Australia, Donald Eykamp had an ongoing appeal at the New South Wales Supreme Court. That case has been resolved. The decision came down on 18 December 2017. I was unable to obtain a copy of the decision until after I had returned to Australia. I carefully read the decision, then conferred with an Australian barrister.

The decision was a disaster for gun owners. It gave the New South Wales Police everything they asked for. Then, it gave them things they did not ask for.

For a while, the politics looked promising. The New South Wales government passed a firearms reform measure that gave the police some discretion about confiscating guns in gun storage cases. That legislation went into effect in November of 2017.

The appeals process took about a year and a half, a bit longer than average. In the end, the court ruled on a number of things, all with bad results for the gun owner.

Here is a summation of the ruling:

The police had no discretion to *not* confiscate the guns. The law required them to confiscate them.  The new law did not apply because the law was different at the time of the original offenses.

The judge had no discretion to order the guns be sold and the proceeds given to the gun owner.

The judge had no discretion to order any of the guns destroyed. That power was reserved to the police.

The court had no discretion to legally separate non-firearms parts (in this case, expensive European telescopic sights)

Destroying valuable cultural artifacts for no good reason. It reminds me of the Taliban destroying the Buddha statutes. Most of the guns were Winchester Super-Grade pre-64 model 70 rifles and original Colt percussion revolvers.

I thought all of their problems were solved with the mandatory turn over of all private firearms.

This is pointless but the motivation is clear that their government is on the road to oppression.

A few at a time in each locale, each in the middle of the night after staying awake for days or weeks. Then featured in the local papers as a nut, items that he owned itemized to show how dangerous he is.

This is to all readers.

That pretty nearly played out during the '90s, even though there was no gun control like we're about to see. Providing only for number one is a fatal error. So you, Walter Mitty, have all your stuff, I see.

Most of you will live through the confiscation experience, and you'll wish you'd have joined an organization that defends our Second Amendment. Your fantasy will be broken, and so will you. You'll wish you'd have voted in the midterm elections to defend your Second Amendment rights and to keep our President from being impeached.

I disagree with “few”. If government one day wants a civil war by turning on the people, former Yugoslavia, Iraq, Syria among other conflicts will be nothing to a second American Civil War or Revolution. The key for the left is pacification and dumbing down the people while incrementally shredding the Constitution. If the government intends to “squash” fellow Americans good luck because they could never handle insurgency and if this includes the military how many would point their weapon at another American for American Totalitarianism and Socialism? Nobody that I served with would. I do think this is why Obama did what he did with the military. Maybe a General or two would follow through but if SHTF, their shelf life is small.

That is why the government does not want a civil war.

They want to accomplish the disarmament gradually, over generations, as each new generation of school children are taught that guns are bad and government is the provider of all good things.

It has only been partially successful so far. The majority of the population now accepts that full auto firearms should not be allowed in private hands.

The left and the media are constantly preaching that ordinary citizens should not be allowed “weapons of war”, even though those weapons are specifically protected by the Second Amendment.

It is a mistake to think the government will attempt to disarm everyone at once. They won’t.

They want people to bury their guns. It is just as good as confiscating them.

When a grandson finds them 50 years from now, they believe he will quickly turn them over to the government in disgust, as is happening in England and Wales.

We must win in the battleground of ideas before we can win in a Civil War.
