He supposedly wasn't being paid, but he's guilty of being in possession of classified documents and info.

As a follow up, Richmond claimed back in January that he was Comey's lawyer:

Since Comey recently hired Patrick Fitzgerald as his attorney, it will be interesting to see who Richmond lawyer's up with, because he's definitely going to need a lawyer.
