Murder Charges Filed In 2015 Texas Biker Shootout That Left 9 Dead (Waco)

Three bikers were indicted on murder charges Wednesday stemming from a 2015 shooting involving police outside a Waco restaurant, including a prominent member of the Bandidos motorcycle club.

The indictment marks the first murder charges in the Texas case and comes just eight days before the statute of limitations runs out. More than 20 other bikers were re-indicted on new charges ranging from rioting to tampering with evidence.

Police arrested nearly 200 bikers following the shooting at a Twin Peaks restaurant that left nine people dead and 20 injured. Investigators say the incident was sparked by rivalries between the Bandidos and Cossacks motorcycle clubs. Waco police officers monitoring the gathering also fired on the bikers.

Surveillance video from the Twin Peaks shootout shows biker gang members shooting guns, taking cover inside the restaurant and running from gun shots. More than 430 weapons were recovered from the crime scene, including 151 firearms.

Jeff Battey is among the three Bandidos members charged with murder. His attorney didn’t immediately return a message from The Associated Press.

According to Waco police incident reports reviewed by The AP, Battey, a former Marine, and another Bandido charged with murder Wednesday, Ray Allen, were seen “triangulated” over Matthew Smith, a Cossack who died at the scene from gunshot wounds. The third Bandido member indicted Wednesday was Glenn Walker.

They already had arrested these people; there is a statute of limitations on how long you can keep them in custody/on bail without either sending them to trial or letting them go. The statute is on the prior charges.

I believe the statute of limitations in this case is on the police holding these men without advancing their case.

Speedy trial and all that. 3 years is more than plenty to figure this crap out.

I think it is a poorly written statement in the article.

There is no statute of limitations for murder.

There is a statute of limitations for the charges they were all arrested upon. They were about to expire.

All the bikers arrested following the shooting were charged with engaging in organized criminal activity, a felony, but prosecutors have dropped 154 of those cases in the last four months, saying they wanted to focus on those who were “more culpable.”

This is the most messed up prosecution I've ever witnessed. Wac(k)o living up to it's reputation with Fed help.

reasonable doubt of self defense. These cases will fail. “murder” — what a joke. How much of this bill has been paid by the poor people that live there. None of this is covered by the state. They are going to have to sell bonds,

rioting? tempering with evidence? Now remember the were all considered accessories to organized crime and murder. Truly sickening judicial process. Of the remaining charged, I wonder how many will ultimately be convicted? My gut tells me, very few.

I will cue it. Police see using people for target practice far far away. To what end? Maybe that’s the way you like it on hillbilly country or wherever you live. It’s not my particular taste. But then you wouldn’t like me. I’m a New Yorker.
You are telling me that have been no, absolutely zero, fights between black gangs in Texas. Funny I don’t ever remember reading about 200 people being shot at and incarcerated forever. Nothing worse than useful white idiots

This whole event was so tainted by the corrupt Powers That Be, that they should all be let go.

It was a set up from the get go, to nail the Bandidos.

The only 3 charged with murder are Bandidos.

Yep. You are certainly free to invite the Bandidos into your life. Perhaps you can come to some nice little arrangement concerning the female members of your family.
We have a bunch of Hell’s Angels here. Drugs, prostitution, murder, racketeering, wonderful people. I particularly like the one here up on charges for beating and raping the wife of a former member. Lovely folks. It was especially fun when rival gangs come through and they are rushing around racing maniacally through traffic to aid their fellow gang, oh sorry, club members. Gotta love the Harley folks that dress up and pretend to be like them. A couple of years ago they ran a Harley rider wanna be biker gang, oops, club member off the road into a guardrail and dang near killed him. Sweet, fun loving guys. I get to enjoy the sweet sound of their illegally, insanely loud bikes ripping up and down the highway all hours. Ah! The ambiance!

Anyone who has seen the videos knows there were some blatant killing going on by a certain few bikers. The main problem and complaint is there were almost 200 people arrested, harassed, and made to suffer needlessly by the DA Reyna.

The point has always been; separate the wheat from the chaff and get on with it. Take a look at the LEO behavior while there too. Was it justified? Was this method smart or really stupid?

No one ever said everyone was innocent; just that the vast majority of those arrested were.

My guess is still ZERO.
The accused still will not plea bargain, and the prosecution still will not release the ballistics and unedited video to the defense.

So, more nothing - now with fewer members of the public sympathetic to the state.
