Supreme Court rules state law banning political apparel at polls is illegal

The Supreme Court on Thursday rejected a Minnesota law banning voters from wearing political apparel to the polls, saying it was too draconian in stifling Americans’ First Amendment rights.

The 7-2 decision said it may be possible for states to restrict stridently political T-shirts and buttons, but the justices said Minnesota didn’t justify why its law needed to be so broad.

I would hope this would carry over to other public places - such as schools. For too long anti American slogans were acceptable but pro American ones were banned.

More lawsuits in the future.

Don’t like the wiggle room on “stridently political” apparel.

Either the First Amendment means what is says, or it doesn’t.

If voters are so stupid as to change their votes at the last second because of something written on a cheap tee shirt, they shouldn’t be voting any ways..............

[Plaintiff] couldn’t vote in 2010 because he was wearing a T-shirt with the emblem of a local tea party group and had a button asking for poll workers to check his ID.

So RBG and Sotomayor dissented. Can't even ask to check voter ID's. That crosses a clear line regarding inadmissible speech. It resonates of hate.

So basically libs can allow lib shirts and reject conservative ones, they just call the ones they don’t like “stridently political.”

SCROTUS falls way short again.

A voter needs to show up vote and move on. And should be able to wear whatever they want.

A poll worker shouldn’t wear clothing endorsing either party or candidate.

Campaign workers, outside of going in once to vote, need to stay the prescribed distance from the polls.

Anyone trying to intimidate voters needs to spend time in the pokey.

I remember in the 90s I had an “Impeach Clinton” button and they wouldn’t let me wear it to vote. I explained that this wasn’t a presidential election to no avail. Realizing the poll worker was just trying to do her job I took it off to vote.

The difference is campaigning is actively speaking for a candidate. Wearing, say a MAGA hat, is support for a candidate you have no direct affiliation with or even if you did and you were just there to vote. Now you don't have to change shirts or leave your hat in your car or down your pants.

The ruling itself can be found HERE. (supremecourt.gov)

I find it's generally worthwhile to read the court's reasoning instead of what you find filtered through the media, which will lie any time it's agenda is threatened.

I think the other difference is a private citizen wearing a shirt with a defined or perceived political message is far different than a campaign worker or election officer wearing one.

Now, to decide. NRA or MAGA hat when I go vote?
