Agency: Court can’t appoint prosecutor against Arpaio

PHOENIX (AP) — The U.S. Justice Department says an appeals court overstepped its bounds when it ordered the appointment of a special prosecutor to pursue an appeal involving a pardon of retired Arizona Sheriff Joe Arpaio.

The appointment was previously ordered by a three-judge panel of the 9th Circuit Court of Appeals.{snip}

The Justice Department said in its appellate brief that “the government does not abdicate the prosecutorial function when it agrees with a defendant on a legal question.”

Arpaio’s attorneys argued that appointing a special prosecutor “raises serious questions about whether the court is actively participating in the prosecution...."

Has there ever been a case where an appeal occurred against a Presidential pardon? I just can’t think of a single case. Nor can I see how any court could order a special prosecutor, or bring charges against anyone. Maybe you could do stuff like this in Mexico or Venezuela, but this is pretty wild stuff to imagine these dimwits coming up with this idea.

Legal advocacy groups that focus on free speech, democracy and civil rights asked for the prosecutor and have mounted a challenge to Trump’s pardon of the former six-term sheriff.

Arapio was pardoned and the whole damn case becomes null and void and of no merit. It means it did not even happen. It should be noted when Bill Clinton pardoned Marc Rich (biggest tax cheat in history) as was he perfect legal right, it means, "it did not happen."

Note to advocacy groups, "GO POUND SAND."

Right - this is not a matter that is even justiciable. The judges on the 9th Circuit have demonstrated total incompetence - at best. This is middle school level civics...and these people have law degrees and are wearing black robes?

Actually, yes, there is. It was on the matter of the pardon being valid if it is not accepted by the party for whom the pardon was granted - in that case, the Court ruled that the power of pardon was absolute, but that the pardon has to actually be accepted by the receiving party to be valid. That is certainly not an issue in this case.

The 9th Circuit Court needs to be revised from one to three CCs. It covers far too many States as it is now and is filled with far left liberal activist judges.
