Kavanaugh's role in ObamaCare's survival fiercely debated by conservatives

Did Judge Brett Kavanaugh write the roadmap for saving ObamaCare?

That question has dwelled at the center of passionate debate in the conservative legal community for days as Kavanaugh, a federal appeals judge in the District of Columbia, finds himself as one of President Trump’s four finalists for a place on the U.S. Supreme Court.

The allegation from conservative critics is rooted in a 2011 ObamaCare case where Kavanaugh dissented against the ruling but acknowledged that the Affordable Care Act’s “individual mandate provision” could fit “comfortably within Congress’ Taxing Clause power.”

Kavanaugh's detractors say that language helped provide the roadmap for the Supreme Court to uphold the mandate a year later.

My opinion: No Kavenaugh.

“Walker argued that Kavanaugh’s “hypothetical discussion” about the Taxing Clause has been misinterpreted and is actually “a roadmap to the conclusion reached by the dissenters—that the individual mandate is unconstitutional under the Taxing Clause.”

“I am very familiar with that opinion, because I served as Kennedy’s law clerk that term,” Walker said. “I can tell you with certainty that the only justices following a roadmap from Brett Kavanaugh were the ones who said Obamacare was unconstitutional.””

Hargan that a teenage illegal alien caught at the border and put in detention has a right to an abortion in the United States.

At the same time, Kavanaugh conceded that “this case presents a new situation not yet directly confronted by the Supreme Court.”

Kavanaugh argued that in saying the illegal alien teen had a right to abortion in the United States he was accepting the government’s assumption regarding existing Supreme Court precedents.

Kavanaugh did say that the majority of the appeals court was mistaken in saying the illegal alien had “a right to immediate abortion on demand.” [Emphasis added.] He argued the government could delay the abortion while seeking to find the illegal alien a sponsor.

Kavanaugh was unable to reassert his authority. The grand jury was laughing at him. The proceedings were out of control."

It was at that point, reports Evans-Pritchard, that Patrick Knowlton was finally compelled to confront the obvious: "the Office of the Independent Counsel was itself corrupt." (pp. 106-107)”

Let's skip the Empire of propaganda behind the canards.

According to some articles here and there, Leo provided the list of potential nominees and has some influence over who was selected. If the Trump Administration listens to Leo, with the influence that feminism has in Leo's demographic, it will be Barrett.

Fox News now reporting that Kavanaugh will be the pick.They said his name has been cleared off the docket for upcoming cases on the DC circuit. If it’s Kavanaugh he’s caved to the Deep Staters and ignored all the slimey crap the crook has did in all his years of being a Bushie. If it’s Kavanaugh he’s ingnored all the concerns of conservatives. Kavanaugh has said time and again that Roe v, Wade is settled law. Ain’t nothing changing with the establishment cronie Kavanaugh.
