I would advise people to stop listening to Dershowitz. He was on the View and he sounded much different than when he is championed on FOX.

He is still a two faced RAT and cannot be trusted.

It was basic math. Trump loses one GOP vote with Kavanaugh. He’d lose two or more with Barrett and that would put the nomination at risk. I see McCain resigning if he can’t make the vote, freeing up his replacement to vote, and Pence casting the tie-break vote. And that assumes no Dem Senators seeking re-election in Trump states break ranks with Schumer.

Actually, some of us are capable of listening to multiple points of view and using our own good brains to form our own opinions.

The level of stupid on FR these days is just staggering.

WHY does the FedGummint have any say AT ALL on abortion..?

How many times did The Framers mention it in the Constitution..?

ZERO times.

Therefore it is 100% a matter for the STATES, where it could be TOTALLY legal or totally illegal.

Oh Dershowitz is by no means a conservative and has never claimed to be, he'll tell you right out he's a liberal. The difference is he's a old school liberal of the JFK variety (there are very few left), meaning he can actually be relatively sane about most issues.

Did not read the whole thing but I feel personally that Dershowitz is wrong on support for Abortion as it stands, with a lot of restrictions not as birth control it may survive but the numbers would be drastically reduced.

As to the Barrett play, yes, Trump worked them good with his only bullet before the Election. In another article posted here on FR I see that even Schumer has his tail between his legs, there is really no winning position for him especially if Kavanaugh avoids jumping on Abortion and as I stated in another post it erupts from a lower court but cannot originate under any circumstances as a dictate from SCOTUS as they are not allowed by law to just jump in first.

“I don’t think the President decided not to pick Barrett, I think he decided to not to pick her for this vacancy. I think he anticipates several vacancies. If Ruth Bader Ginsberg leaves, he might pick her then. The American people have to know one thing that distinguishes these two. I think that, very likely, Kavanaugh will cut back on Roe Vs. Wade. I think he thinks it was wrongly decided, that it should be left to the states. Barrett may have a very different view. She believes that there is a right to life that the fetus is an innocent citizen of this country. And basically, maybe she believes, that states don’t even have a right to permit abortion. Most Americans won’t support that,” Dershowitz said.

If a State starts a suit to limit or abolish Abortion the fuse is lit, and it goes to SCOTUS and then we are getting somewhere

Trump was never going to put a fourth woman on the court. If Ginsburg, Kagan, or Sotomayor leave then maybe.

I believe Trump passed over Barrett because she hasn’t been at the appellate court level long enough to build a track record as a Federal judge that would demonstrate her legal philosophy.

Social policy should be left to the states. Abortion or marriage should be none of the federal government’s business.

By telling states they can’t regulate in these areas, the courts have pre-emptied political solutions and widened our social divides.

Roe and Obergefell didn’t settle anything and even liberals know people will never accept the reasoning behind these decisions as legitimate.

They were wrongly decided and should be overturned.

Ginsburg is around 84 years old and Sotomayor has Type I Diabetes and is about at the end of her expected lifetime with that disease. Breyer is old too.

John Paul Stevens served till he was 90, and he’s still alive and kicking after 8 years of retirement. Oliver Wendell Holmes also served till he was 90 and lived four more years after he retired. Ginsburg, Sotomayor, and Breyer will die on the bench, and that could be 6 or more years away.
