California College Stops Student from Handing Out U.S. Constitution on Campus, Gets Sued

A California college student is suing the Los Angeles Community College District (LACCD), claiming that his First Amendment rights were violated when his school prohibited him from handing out copies of the U.S. Constitution.

Kevin Shaw, a student at Pierce College in California says he was stopped from handing out Spanish-language copies of the U.S. Constitution on campus because it was not inside the school’s designated “free speech area.”

In his lawsuit complaint, Shaw alleges that, while he was handing out Spanish-language copies of the U.S. Constitution, he was forced to stop and was then escorted into an office and told to complete a permit application to use the college’s “Free Speech Area.” The free speech area measures 616 square feet and comprises approximately .003% of the total area of Pierce College’s 426-acre campus.

The original complaint filed in March of last year by Shaw states that “restricting all First Amendment activity to Pierce College’s tiny, designated Free Speech Area impermissibly restricts student expression, does not serve a significant government interest, and is unconstitutionally vague and overbroad.”

The lawsuit was filed by Arthur Willner, a partner at Leader & Berkon LLP, in partnership with the Foundation for Individual Rights and Education (FIRE), an organization that advocates for freedom of speech on college campuses.

Free speech area is anywhere in the United States, 100%. Close the school and send the students home.

Better yet, reopen the school in Venezuela.

A classic example of why public education is a train wreck in the United States.

The Los Angeles Community College District (LACCD) has nine community colleges, 134,887 students, an annual budge of $5.8B of which $4.4B is restricted to a Building Fund for the construction and maintenance of facilities, leaving $1.4B in the general fund for teaching students or $10,379.06 per student.

Pierce College, is one of the nine, with 22,000 students and a $82,327,357 annual budget or $3727.27 per student.

More than 55% of the LACCD workforce are indirect (overhead, General & Administrative) labor filling various administrative roles with no involvement in teaching students. 45% of the workforce is direct labor, either as instructors or providing direct support to the students (e.g.. the custodial staff in a building, or food service workers in a dining facility.) In general, indirect labor positions pay better than direct labor positions for the same skill and experience level.

If you find this shocking, check the employment figures for your local school district. Generally, less than 40% are direct labor, and the indirect positions have better salaries and benefits.

In the private sector, an indirect staffing rate above 30% would be unusual, and probably the target of significant cost reduction initiatives.

The lawsuit names 12 individuals in the management chain before identifying the Pierce College employee (as “John Doe”) who actually stopped Kevin Shaw from handing out copies of the U.S. Constitution.

Here’s hoping Kevin prevails in his lawsuit, is awarded and collects a large sum of money from the State of California, the LACCD, Pierce College, and the 13 individuals named in the lawsuit before California, the LACCD, and Pierce College go bankrupt.

If there is any justice, and out respect for the taxpayers of this nation, the 13 individuals named in the lawsuit would face a lifetime prohibition on employment in any position funded by Federal, State, or Local government.

By designating a “free speech” area, they declare that all other areas are off limits to free speech. Then they reveal their true intentions by limiting what can be said in the free speech area.
