Tuesday’s decision by the 9th Circuit Court of Appeals means that people in the western U.S. will now be able to openly carry a handgun in public. The decision only applies to districts under the 9th Circuit’s jurisdiction, but it will likely soon affect the rest of the country. It is a huge ruling that strikes down existing state prohibitions in Hawaii and California.

I believe that this verdict is by a 3 judge panel of the 9th Circuit. It can be overturned by a full seating of the 9th Circuit Court. This will likely be the final outcome in the 9th Circuit. Any and all verdicts can be appealed to SCOTUS. If this happens it is hoped that it is after Kavaugh is approved for the open Justice seat.
In any event if two circuit courts have opposing rulings on an issue it is then decided by SCOTUS. This issue is far from settled even with this small victory.
There is a long way to go in overturning California’s unconstitutional gun laws. Hopefully before I die so I can rest in Peace knowing that that Republic will survive with the cornerstone of the 2nd Amendment is intact. It is the foundation of our Bill of Rights.

Shouldn’t it apply TO THE ENTIRE NATION? Why can a single thug in Hawaii shut down immigration law nationwide but an entire appeals court decision only apply to the left coast?

So how come when of the hack renegade Judges makes an outrageous ruling he/she makes it apply nationwide?
Apparently, Hawaii lawmakers are going nuts over this. They are demanding an en banc appeal. I hope they do exactly that.
The 9th circuit would then be faced with a major dilemma. They already said there is no constitutional right to concealed carry. The ruling of the 3 judge panel was that that therefore must mean there is a right to open carry. So what does the 9th do? Either say there is no right to open carry - meaning there is no right to actually bear arms since you can’t do it openly or concealed. That then triggers an appeal to the Supreme Court which with Kavanaugh seated, likely overrules them and sets precedent requiring open carry nationwide....yes you New York and you Maryland and you New Jersey....you all have to eat it.
OR, the 9th has to agree with the 3 judge panel in which case Hawaii and California have to eat it and allow open carry.

Of course we need Kavanaugh to be confirmed so we can get Supreme Court rulings striking down much of the gun grabber agenda.
A stay is different from an adjudication. Any judge that has jurisdiction can issue a stay, which is suspension of the effects of a ruling, but an adjudication is a ruling that applies the meaning of the law upon which it is based.
At least to my limited barroom legal understanding.

If this stands. Means I can open carry to California? Would prefer to conceal. Same for Hawaii, like when I go their next month.

You’re right. This was a good ruling. But it ain’t over until it’s over.
