4 Men in a Car With Gun at 2 am Results in Misdemeanor
Oak La ^ | August 6, 2018 | Michael Dominic

The Cook County State’s Attorney denied felony charges against any of 4 men, who parked in front of a home with a gun and drugs in a car.

The police were patrolling in the area when the officer observed a strange license plate on the vehicle and decided to follow the car.

The officer pulled behind the car but didn’t activate his lights. When the officer approached the car, he smelled burnt cannabis as the driver rolled down the window. The car had Arizona license plates and the driver produced a title to the car that had not been properly transferred yet.

One of the men allegedly had a bulge in his coat pocket and the police claim that he was holding a clear plastic bag with approximately 12 dime bags inside.

The officer alleged that he saw the butt of a handgun under the driver seat. He reached inside the car to remove a Smith and Wesson handgun with a fully loaded magazine of hollow point rounds with an empty chamber, according to the officer.

Two of the men allegedly provided statements to the police implicating Ingram as the owner of the gun. Ingram denied knowledge of the gun according to the police.

None of the men in the car had a valid FOID Card or a concealed carry license. The police contacted the Cook County State’s Attorney’s Office on two occasions that night asking for approval to charge Ingram with a felony gun charge. In both instances, the Cook County State’s Attorney denied the request.

Ingram, a 25 year old black male with a Chicago address, was charged with one count of misdemeanor unlawful use of a weapon and a Cook County Ordinance ticket for Possession of Cannabis under 30 grams. The other men were not charged.

This is what happens when a BLM activist style individual serves as an elected prosecutor and routinely refuses to charge criminal defendants with felonies. The suspects walk or face minimal charges and good police work goes for nothing.

Cook County State's Attorney Kim Foxx is soft on crime.

I applaud their entrepreneurial spirit and commitment to gun rights.

We may all think it stinks, but prosecution would have failed, given these facts.

We just saw 75 people shot and 19 killed last weekend. Rahm and his sock puppet police Chief were on tv decrying illegal guns and the people who carry carry them.

One might think that an example would be made. But this is Cook County....

Out here in DuPage felony charges would be filed so fast their heads would spin.

It’s known that gun charges are thrown out in Cook county. (But don’t you think you out of state white conservatives can flaunt the law, only Democratic voters from Cook county have that privilege)

All the gun control rhetoric is just gaslighting demoralization propaganda.

It appears there were no prior convictions.

Chicago prosecutors are getting a bit shy of felony gun charges for a first offense. Seems right to me.

10 shot and killed and sixty wounded this past weekend in Chicago. With prosecutors like this, records are simply made to be broken. A cynic might come to the conclusion that people in power in Chicago want and view the carnage as necessary.

Remember the kid from Arizona that had won many sharpshooter awards? He was headed to school in New Jersey and to visit his mom. He was pulled over for speeding, IIRC and the cop searched the car. IN his plastic bag of clothes in the trunk was a box with his sharpshooter pistol. He went to prison for it. I believe Christie eventually pardoned him but it was like pulling teeth.

This is all from memory so I may have gotten the facts wrong. But still, We live in a weird country when you can be awarded for something in one state, and thrown in prison for it in another.

Is there some good Constitutionally sound reason a black citizen with an admittedly unusual haircut, cannot possess a firearm in his vehicle?

It has been my observation that very little good happens in cars at 2 AM.

When you combine it with the dope found in the car, it becomes a felony automatically. The dope was packaged for distribution into smaller bags.

That being said...it is Chicago, so I understand the gun in the car...the law probably needs to be changed.

What is a “strange license plate,” and how does it provide probable cause?

At least one of them is on record and prohibited.

An Arizona plate on a car idling at the curb in the middle of the night, with four men sitting in it. Unusual enough to justify the cop investigating further.

The trouble is the Cook County States Attorney is using the wrong burden of proof in deciding on whether to charge or not. Seems they are looking for “beyond a reasonable doubt” instead of “probable cause” when deciding whether an incident occurred and approve felony charges. C.P.D. Street Deputy can step in and override States Attorney decision, but that only pisses off the State.

They were drug dealers. They were smoking pot and had 12 dime bags ready to distribute.
