JF’nK should have been arrested and tried after his Congressional ‘Speech’ when he said he had observed or had first hand knowledge of US Troops looting, vandalizing and raping Vietnamese citizens.
If he knew of or was aware of such, as a COMMISSIONED OFFICER it was/is his duty to either officially report or take steps to make it stop...apparently he did neither so that should make him liable.
Leads me to believe he had been ‘relieved’ of his Active Duty status at that time, otherwise he would have been (OR should have been) recalled to face charges.
Not sure how the O’s work it but E’s were obligated to 6 years and no matter how much Active Duty was spent, one was ‘liable’ to recall until his ‘Active Obligated Service’ was completed.
