Why Judicial Confirmation Battles Keep Getting Longer and More Vicious
National Review ^ | September 25, 2018 | John R. Lott, Jr.

Judicial confirmations have become a blood sport. Wasn’t it just weeks ago at John McCain’s funeral that Democrats were calling for more civility in politics? We never used to fight so much over Supreme Court nominations.

The whole reason is obvious. The House and Senate have abdicated much of their traditional responsibility of passing legislation that matters and instead letting lawasuits work their way up the chain of the Federal court system to be coded into law by decision not statute.

That way they can straddle the fence, lie, hem and haw and blame someone else. Fundraise ad nauseum from “unelected officials” being faceless evil.

The other component is letting unknown, unelected, permanent bureaucrats in the alphabet agencies make up rules as they go and stretching the boundaries of any existing statue or law. They’re never called on it, never held accountable and can’t be fired.

So there you go, lazy legislature, too powerful court.

Without the courts the Dems can’t control anything in this country. They’re doing everything to retain their control of government to get their power back, but in the process they’re alienating more and more Americans!

In Lindsey Graham’s “Five Minutes of Fury” questioning of Judge Kavanaugh, I believe he threatened the Democrats that the process would be different in the future, if he becomes chairman, because of this unscrupulous assault on Kavanaugh.

"Why Judicial Confirmation Battles Keep Getting Longer and More Vicious"

That's the Democrats' strategy: Intimidation. Violence. Destroy America.

I don’t remember the Sotomeyer and Kagan hearings as being contentious. Looks like the contention is from one direction.

Not when a DEM POTUS nominates someone. We rubber stamp them right on through. That’s how two political leftist hacks are on SCOTUS right now.

Yep. It’s not all of them. The crooked Democrats are desperately clinging to power.

Grassley can't handle the committee and has lost control. He apparently too old to understand that he has been used. Call the vote now and if Flake sides with the Democrats then we know for sure where America is going.

Shame on you, John R. Lott Jr., for failing to mention this obvious fact.

Not all nominations. Kagan and Sotomayor sailed through. Even Ginzberg. But Alito? Roberts? Gorsuch? And now this mess with Kavanaugh. I see a pattern here.
