Text messages suggest Kavanaugh wanted to refute accuser's claim before it became public

WASHINGTON — In the days leading up to a public allegation that Supreme Court nominee Brett Kavanaugh exposed himself to a college classmate, the judge and his team were communicating behind the scenes with friends to refute the claim, according to text messages obtained by NBC News.

Kerry Berchem, who was at Yale with both Kavanaugh and his accuser, Deborah Ramirez, has tried to get those messages to the FBI for its newly reopened investigation into the matter but says she has yet to be contacted by the bureau.

The texts between Berchem and Karen Yarasavage, both friends of Kavanaugh, suggest that the nominee was personally talking with former classmates about Ramirez’s story in advance of the New Yorker article that made her allegation public. In one message, Yarasavage said Kavanaugh asked her to go on the record in his defense. Two other messages show communication between Kavanaugh's team and former classmates in advance of the story.

In now-public transcripts from an interview with Republican Judiciary Committee staff on September 25, two days after the Ramirez allegations were reported in the New Yorker, Kavanaugh claimed that it was Ramirez who was “calling around to classmates trying to see if they remembered it,” adding that it “strikes me as, you know, what is going on here? When someone is calling around to try to refresh other people? Is that what’s going on? What’s going on with that? That doesn’t sound — that doesn’t sound — good to me. It doesn’t sound fair. It doesn’t sound proper. It sounds like an orchestrated hit to take me out.”

The texts also demonstrate that Kavanaugh and Ramirez were more socially connected than previously understood and that Ramirez was uncomfortable around Kavanaugh when they saw each other at a wedding 10 years after they graduated.

Ramirez said she spent at least 6 days trying to reorganize her memories , talking to people and her attorney. She hired an attorney at least a week before she went public, probably longer

It's funny, because Kavanaugh is asking these classmates to tell the truth and exonerate him.

You'd think from the breathless reporting Kavanaugh was asking them to lie for him or something.

Kavanaugh has a quoted denial in the New Yorker story, which means he knew they were working on a story before it actually published. How soon prior to the Sept. 23 print date did he or his people get wind of the fact that New Yorker was running a hit piece on him?

No it doesn’t! If you read his comments he was angry about her lying and trying to get others to remember that he did something to her. He wanted to attack it head on immediately. I would do the same thing and not sit around waiting for it to be a news item

What kind of utter nonsense is this? Are they trying to argue that Kavanaugh was psychic and could sense what she was going to allege before he even knew she was going to allege it?

This is ridiculous - she was the one going around calling people which alerted Kavanaugh to it. That’s why the NYT wasn’t going to run the story. The Senate Democrats were also looking for someone to say things like this as confirmed by the New Yorker reporters. NBC has lost its marbles.

Rameiz turned down the committee 7 times to talk about her allegations and would only say have an FBI investigation.

Deborah Ramirez, a Yale University classmate of Supreme Court nominee Brett Kavanaugh, is refusing to talk to the Senate Judiciary Committee about her accusation against Kavanaugh, a GOP lawmaker said Tuesday.
Ramirez lawyer John Clune tweeted Tuesday that “We have been working hard to cooperate with the Senate Judiciary Committee...and they have refused to meet all scheduled appointments.”

He said Ramirez wants an FBI investigation, not a congressional investigation.....

A top Judiciary Committee GOP aide told the Washington Examiner in response to the Clune claim, “The Ramirez legal team has declined to comply with the committee’s established process and investigation and seem to prefer working through the media.”

...One unnamed classmate recalled hearing about the event contemporaneously while another, Mark Krasberg, said Kavanaugh’s conduct at Yale was much discussed among alumni after his nomination to the high court.
Two male students Ramirez claimed were present during the misconduct deny that it occurred, while three other classmates who knew both Kavanaugh and Ramirez said the behavior alleged is broadly inconsistent with the judge’s behavior in college.
Another unnamed student, who said she was one of Ramirez’s closest friends at Yale, said Ramirez has never mentioned the event.

George Hartmann, a spokesman for Senate Judiciary Committee Chairman Charles Grassley, R-Iowa, said that “the texts from Ms. Berchem do not appear relevant or contradictory to Judge Kavanaugh’s testimony.”

“This appears to be another last-ditch effort to derail the nomination with baseless innuendo by Democrats who have already decided to vote no,” Hartmann said.
