It’s crucial for courts to be predictable. That way the lawyers can tell their clients how the law is going to be applied. Uncertainty in the law is where all the problems arise.

Both parties have their issues, but with things like this it’s always the Democrats, not the republicans.

And look at the actual court picks. The ones picked by R’s are the ones that side with the constitution. The ones from the D side rarely do. In a sane world, most supreme court decisions would be 9-0. This contant 5-4 thing is on the democrats.

EXACTLY!! Well said!!

Uncertainty and having a "swing vote" leads to indecision and chaos. And of course that is the liberal mantra for taking over all of government.

Essentially she’s saying that it is just fine to have justices that are on the extreme left, such as herself and the wise Latina, but it’s not OK to have someone who actually interprets the constitution as it was written.

Kagan and Sotomayor are rubber stamp partisans. They are ridiculous often, and here too. Nice to see them pulling the classic Obama move, attack your enemies for the things you do while trying to claim the moral high ground as if you are saintly above your own actions. Sick, backwards, swampy creatures. Sotomayor gets the extra award for being racist. Kagan also a beauty as she never sat on a bench until the Supreme Court. lol. The Left are not serious people.

I find this sort of analysis to be fascinating:

Almost all justices slide leftward over time.

(also interesting that "median" Justice and Kennedy coincide of late; O'Conner was the median Justice before Kennedy. Roberts obviously will be picking up the mantle.)

If the witch Hillary had won she would have packed the courts with the most extreme liberals she could find. And there would NOT be a peep about 'raising above partisanship'.

As I listen to oral arguments often, Sotomayer comes across as an incompetent hack while Kagen comes across as a very competent foot soldier for the progressive left. Their voice and vote is 100% reliable. That’s why they were nominated.

I foresee these wise justices leaving the court when RBG takes the dirt nap... and establishing a shadow court for red states..... this is how CW2 will start to become hot.

The Dem appointments to SCOTUS never go off the plantation. They vote on the big issues as an ideological bloc. OTH the Rep appointments have been mixed with some Justices moving to the left once they get on the court. Thus the only “moderates” have been Rep appointments.
