FUSION GPS FOUNDER WILL PLEAD THE FIFTH TO AVOID TESTIFYING TO CONGRESS

The co-founder of the opposition research firm behind the Steele dossier, Glenn Simpson, will invoke his First and Fifth Amendment privileges to avoid testifying before Congress next week, his lawyer has told Congress.

According to The Hill, Simpson’s attorney, Joshua Levy, told House Judiciary Committee Chairman Rep. Bob Goodlatte that Simpson will not appear for a deposition because the congressional investigation “is not designed to discover the truth.”

The Virginia Republican subpoenaed Simpson on Sept. 29 after Levy said his client would not appear voluntarily for an interview before members of the House Judiciary and House Oversight & Government Reform committees.

Simpson’s firm, Fusion GPS, was hired during the 2016 presidential campaign by the law firm that represented the DNC and Clinton campaign. Fusion GPS hired former British spy Christopher Steele to conduct an investigation into Donald Trump’s possible links to Russia. The result of the probe was a 35-page report alleging collusion between the Trump campaign and Kremlin.

Republican lawmakers are interested in the dossier, largely because the FBI reportedly relied on the unverified document to obtain surveillance warrants against former Trump campaign adviser Carter Page.

In addition to investigating Trump and his associates, Fusion GPS has helped plant anti-Trump news stories with numerous news outlets. Simpson helped arrange meetings between Steele and journalists from The New York Times, The Washington Post, The New Yorker, and Yahoo! News.

You know what? I’m Ok with that.

That is his absolute legal right. And even if formally arrested and indicted, he has other rights.

* The right to legal councel.
* The right to be tried in an open court before an impartial jury of his peers.
* The right to confront witnesses and evidence against him and to cross examine or otherwise impeach said witnesses and evidence.
* An absolute presumption of innocence, until such time as a jury concludes that the evidence has proven his guilt beyond a reasonable doubt.

Because this is one of those things things that defines us as a country and marks us out as Americans.

The House Judiciary committee should make him plead the Fifth in front of the whole nation. Then, at the end of his non-testimony, the committee should vote to send a criminal referral to DOJ. He definitely perjured himself in his earlier testimony.

Exactly, he has that right and at the same time, I have the right to realize that he is, in a way, admitting guilt. What he is saying is, in effect, “I’m not gonna confess. So you have to prove it some other way.”

They have this right. I think they should be forced to show up and say it, not mail it in, but that's up to congress. But I think there should be an obvious consequence: a company that refused to testify under a subpeona from congress should be immediately barred from government contracts. I don't know if Fusion GPS has any government contracts but if they do, they should be terminated.

I don't intend this as a punishment for their exercising their right. Rather, I think a company that refuses to cooperate with government oversight is an ethical and security risk.

Actually I think that warrens should be taken out on the principles of the company.

What is happening here is that in order to continue the theme of the illegitimacy of the current administration, the Deep State players are ignoring the administration and its agents.

This is dangerous stuff and needs to be dealt with firmly.

That's what I thought, too.

But reading FindLaw on the fifth just now sheds a different light on it:

At trial, the Fifth Amendment gives a criminal defendant the right not to testify. This means that the prosecutor, the judge, and even the defendant’s own lawyer cannot force the defendant to take the witness stand against his or her will. However, a defendant who does choose to testify cannot choose to answer some questions but not others. Once the defendant takes the witness stand, this particular Fifth Amendment right is considered waived throughout the trial.

I doubt very much that Glen Simpson is the big fish in this conspiracy. He should be subpoenaed, given immunity, and then jailed for contempt if he refuses to give up the other conspirators.

Can’t Mr. Simpson be give immunity from any self incrimination in his testimony and then he has to testify? I remember Congress claimed they could do nothing about Lois Lerner refusing to testify using the fifth amendment and acted helpless and someone in the media did point out they could have given her immunity in which case she had to testify but most of them did not care for the Tea Party and nothing came of it. After all Mr. Simpson is just a small fish in this conspiracy.

How was this right ported over to the congressional arena? To their oversight? I’m gonna guess a SCOTUS decision....

Here is an idea:
1. Force him to come to the hearing.
2. Make him publicly plead the Fifth.
3. “Congratulations Mr. Simpson, this is your lucky day. The committee has granted you FULL IMMUNITY for your testimony. Here is the formal grant.
Now, you are going to tell us EVERYTHING we want to know.”

Can you imagine his face at that moment? He would be truly F****D.

Refuse to testify, go directly to the jail cell in the basement.

Testify and lie... legal trouble.

Testify fully and openly and tell the truth, lets call it trouble in his “Social Network”.
