‘Political lynching’: Leading black Democrats scold party for stance on Rep. Melton ( Colorado )

As calls mount from both the left and the right for Democratic state Rep. Jovan Melton to step down from his House District 41 seat in Aurora, supporters, including former Denver Mayor Wellington Webb, argued Thursday that a double standard is being applied to Melton by the leadership of the Democratic-controlled Colorado House and the Colorado Democratic Party chair, Morgan Carroll.

Webb ... called out the leadership of the Democratic Party ... “Jim Crow system of justice” and a “political lynching” of Melton.

And while they didn’t go so far as to tell African American voters not to vote in three weeks, they said they are tired of being used by the Democratic Party, which they said has turned on an African-American leader over a domestic violence charge for which he was tried and served his sentence nearly 20 years ago.

In “their urgency to rush to judgment, they’ve created a double standard,” Mayor Webb said of Democratic leaders. “We are not here to retry the Melton case. It was adjudicated 20 years ago.”

He called the Democratic House leadership hypocritical for calling on Melton to resign when they did not do the same in three other instances in the previous two years.

Webb cited the sexual harassment allegations made against Rep. Paul Rosenthal of Denver, complaints that House Speaker Crisanta Duran dismissed because those alleged incidents took place before Rosenthal was a lawmaker.

Webb also pointed to the DUI arrest of Democratic Rep. Dan Pabon of Denver last year, noting Pabon was not asked to resign. The third incident cited by Webb was Duran’s promotion of former Rep. Steve Lebsock of Thornton as chair of a House committee when she knew he had been accused of sexual misconduct. Lebsock was expelled by the House last March.

Melton should call for a full background check investigation of every Colorado Democrat officeholder going back 30 years, and then tell them all that any one of them that wants to “throw the first stone”, go ahead - hypocrites.

He was appointed by Jimmah Cahtah, and the democrat controlled Senate did not bar him from future federal office. He was removed. I wonder if the Dimms are headed for a major schism as the nutjobs on the far left continue to drag this sorry party down into the gutter? This is not a true party - it’s a loose coalition of various special interest and identity groups.

Yeah we have our own RINO factions, I know, but in general we have our north stars of less taxes, less government, more individual liberties to guide us.

If his supporters opposed the confirmation of Brett Kavanaugh, they are the ones with the double standard. Regardless, they've had plenty of time to leave the plantation, yet when the election rolls around in a couple weeks, they'll go down to vote straight ticket Demwit.

While everything you said about Hastings as a person is correct, it simply is not true that the RAT Senate could have barred Hastings from future service in Congress. Article I, section 3, clause 7 of the U.S. Constitution provides that the judgment in cases of impeachment shall extend no further than removal from office and disqualification for future service in an “Office of honor, trust, or profit under the United States,” which refers to high offices in the federal Executive Branch and Judicial Branch but specifically excludes membership in the U.S. House of Representatives or Senate. The Framers were very sensitive to the abuses that the British had carried out against Member of Parliament John Wilkes, including expulsion from Parliament for political disagreements, and ensured that no one could be prohibited from being elected to, and serving in, Congress even if previously impeached and convicted (something that Article II, Section 4 of the U.S. Constitution limited to the President, VP and “all civil Officers of the United States”) or previously expelled from Congress. That members of Congress are excluded from the definition of holders of an “Office of honor, trust, or profit under the United States” is evidenced by the fact that Article II, section 1, clause 2 of the U.S. Constitution provides, with respect to presidential Electors (i.e., members of the Electoral College) “but no Senator or Representative, or Person holding an Office of trust or profit under the United States, shall be appointed an Elector.” So the Senate, when it convicted Hastings in his impeachment trial, could not have barred Hastings from later serving in the U.S. House of Representatives; to keep Hastings out, the House would have to expel him (by a 2/3 vote) and, if his constituents nevertheless elected him again, expel him once again (and rinse and repeat).

You mean elect as president again? Not if he was convicted by the Senate and banned from future office under the United States. He wouldn’t be able to serve as Ambassador to the UN or federal judge, either (not that those would be in the cards), but he could be elected to the House or Senate even if impeached and convicted.

Of course, even if the Democrats take the House this year (which is doubtful, and I think they’ll fall about 5 seats short), and even if the House actually impeaches President Trump (which is unlikely unless he actually does commit a serious crime), there is no way that he’ll be convicted by 2/3 of the Senate.
