Law requiring a birth certificate to register to vote advance moves to appeals court
The Washington Times ^ | November 4, 2018 | Rowan Scarborough

The debate over how to sift out illegal voters from legal ones has reached the federal appeals court level, making it possible the Supreme Court eventually will rule whether a state can demand a birth certificate to register to vote.

The case before the 10th Circuit Court of Appeals in Denver centers on a 2011 Kansas law, the Documentary Proof of Citizenship (DPOC). In June, a district court judge struck down the law, with biting criticism of analysts who contend a large number of noncitizens nationwide vote illegally, tilting close elections to Democrats. Judge Julia A. Robinson said the Kansas legislation violated federal law and the 14th Amendment guarantee to equal protection.

The law, which requires proof of U.S. citizenship to register to vote, is vigorously defended by Kansas Secretary of State Kris Kobach, a nationally known Republican locked in a tight governor’s race. His own primary battle was so close the state attorney general cited it in a brief to the 10th Circuit as a race that could be influenced by illegal votes.

A backdrop is this: the U.S. count of noncitizens is growing. A Yale study says there may be twice as many immigrants living in the U.S. illegally — 20 million — than other analyses have found. That means the population of immigrants, most of whom are over 18, has reached 30 million. The U.S. has about 245 million residents 18 and older.

Amid Tuesday’s elections for control of Congress, conservatives and liberals have starkly different views. The right say thousands break the law by voting, while liberal scholars say the count is so small as to be statistically zero.

“This case should end up at the Supreme Court if the 10th Circuit doesn’t overturn the district court opinion,” said Hans von Spakovsky...

Federal from the late 80's stipulated for states to require a BC for new Driver License and periodically during renewal

I recently had to produce my BC to renew my Texas Driver License.

The Federal Law has only recently been enforced.

Now that Bush League Republicans and Democrats have flooded our country with millions of fraudulently documented foreigners, it is common sense to require proof of citizenship to register to vote.

.
California routinely issues birthcertificates to illegal ‘anchorbabies.’

These BCs are unlawful because they do not note that it is a non-citicen birth.

Gee, you mean Obama might have to produce a birth certificate? I wonder which version he’ll show.

There is no law that requires an American to have a birth certificate. And there is no right to vote anywhere in the Constitution. The ancient truths are nearly forever lost.

Yep, it seems a basic common sense thing and it’s pitifully lacking in way too many.

What I do not understand about all of this, what makes no sense to me at all, is this: If the liberal analysts are correct and the number of illegal votes cast is statistically insignificant, why not just reassure what (I believe) is likely the majority of legal voters who think that they are being disenfranchised by illegal voters and that many democrats who hold office do so illegitimately. Why not, since we are taxpayers and citizens, let us have the assurance that the govt we have, has been honestly elected and truly represents all of the people. Why not spend the next 2 years making sure that every citizen has the documentation necessary to legally register to vote and put the question to rest once and for all?

“,,,while liberal scholars say the count is so small as to be statistically zero.”

If that is true, why waste so much time and money fighting the requirement?

I wonder if they’ll require a BC anymore to get a passport. Why require a passport anyway???

Are the amendments part of the Constitution?

Since you have to have a birth certificate to play Little League baseball, it’s not too much to ask in order to keep illegals from voting.

Yep, they require a BC to get a passport. My cousins burnt many years ago and he needed one for a passport to go to Canada. I and some others went to a notary public and swore he was born in the U.S.

A few months ago I had to show my passport (along with several other forms of ID) to renew my driver’s license.

It would require a deep dive to explain this to you.
The Supreme has identified three “united states” in Law...

The Nineteenth Amendment gives a “right” to a class of people called U.S. citizens.

It’s late, you now have enough for the journey.
