Trump judicial nominees stall on Hill, as Flake digs in over Mueller plan

Confirmation proceedings for President Trump’s judicial nominees have partially stalled on Capitol Hill, as outgoing Arizona GOP Sen. Jeff Flake is standing firm in his vow to oppose all Trump nominations until the Senate votes on legislation to protect Special Counsel Robert Mueller’s probe.

Flake, a frequent Trump critic who opted against running for re-election this year, followed through on his threat Wednesday afternoon and joined Democrats in opposing a bid to advance Thomas Farr’s nomination to serve on the federal bench for the Eastern District of North Carolina. Vice President Pence was then forced to break a tie on a procedural vote, in a rare Senate intervention.

A final confirmation vote on Farr’s nomination had been expected Thursday, but Fox News has learned it has now been pushed until at least Dec. 3.

While nominees like Farr may narrowly advance on the floor, proceedings at the committee level are stuck for now. Late Wednesday, the Senate Judiciary Committee canceled plans for a Thursday meeting to vote on a long list of judicial nominees. Flake is a member of that committee. None of the nominations would have been favorably moved out of the committee if all Democrats plus Flake voted no.

Meanwhile, nominees already passed out of committee could be confirmed on the floor, though they may result in more airtight votes requiring Pence to serve as tie-breaker.

Why isn’t he just booted off the Judiciary Committee since he’s a lame duck and he’s kissing up to Senator Chris Coons (D-De).

Flake told President Trump to go to hell. And Trump just takes it with Twitter his only plan. Flake is a communists Democrat and follows McCain hate for Trump.

Because all the rinos want a vote on protecting the witch hunt. It gives them leverage over Trump. Trump is not defending himself here, I don't know why.

McConnell needs to tell Flake to shuv it. Either put the nominations directly on the senate floor or pull lane-duck ( and lame- brained) fldke off the judiciary committee now. F

The plan is to have a two party co-equal justice department. Then to spend all the budget investigating each other and building an immigrant voter base. As for the real charter of the justice department, they abandoned that in favor of political espionage to the highest bidder long ago.

Legislation to protect Special Counsel Robert Mueller is unconstitutional. It would effectively create a new branch of government unaccountable to the executive branch. The Constitution provides that Congress shall establish the Judiciary, with the advise of the Executive, and consent of the Senate. (per Mile Lee). Removal of the Executive power is therefore, unconstitutional.

Flake is a putz.

Pull the calendar and reschedule floor votes to January and punish Flake by blocking the bill from ever coming to a vote.

Let him twist slowly in the wind. Senate shouldn’t be held hostage to the lines of him.

Yup. Supreme Court said in Meyer in 1926 Congress can’t constrain the President’s ability to remove executive branch officials who serve at his pleasure.

Goes to the separation of powers.
