None of 42 migrants arrested in Tijuana border clash will face charges

US border patrol detained 42 people for illegal entry. Unclear if they will be deported

No criminal charges will be filed against the 42 migrants arrested in a clash that ended with US authorities firing teargas into Mexico.

Rodney Scott, chief of the border patrol’s San Diego sector, has said those arrested for illegal entry included 27 men, with the rest being women and children.

The incident occurred at the border in Tijuana,... As frustrations began to mount over the long wait, migrants marched to the border Sunday to appeal for the US to speed things up. It turned unruly when four agents were struck with rocks or projectiles and authorities responded by launching teargas and pepper spray balls to quell the unrest.

But in the end, none of the 42 people had charges brought against them for illegally entering the country or any other counts.

Customs and Border Protection, the border patrol’s parent agency, referred only two cases to the justice department for prosecution and charges were not filed because the accused had medical problems that prevented them from being held in San Diego’s detention center, according to a US official familiar with the cases who was not authorized to discuss the matter publicly and spoke on condition of anonymity.

Many others were not referred to the justice department because they were children or parents accompanying children, the official said.

The other adults were not prosecuted because Customs and Border Protection didn'tt have enough information to pursue charges, including the name of the arresting officers, according to the official, who said it was an extremely chaotic scene.

The fate of the 42 immigrants remains unclear. Customs and Border Protection declined to discuss why charges were not filed but said they still may be subject to deportation.

Why are criminal charges not being filed against the invaders that assaulted our border patrol?

A. It was too chaotic -so they don't know who was the arresting officer ?

B. The accused had medical problems ?

C. Because they were children or parents accompanying children?

Three lame excuses that would not stop a cop from arresting you or me (plus we'd suffer a beat-down in certain jurisdictions.) One of our guys could have lost an eye or suffered a severe skull/facial injury.

Illegal aliens are privileged - above the law- this is shameful.

typical bullshit lies from the guardian: the invaders were trying to break down the border wall and invade the U.S., not just march up to it; so they were destroying U.S. property as well as assaulting U.S. government agents with rocks and such ...

detain them somewhere - with minimal survival needs, tents to live in. it doesn’t have to cost much. They came illegally and deserve nothing as they wait their deportation or day in court before deportation. To have them loose means innocent people will be harmed - no question about it if they were willing to fight with BP they will harm others.

Failing to enforce the law means there is no law.

Selective enforcement leads to corruption, favoritism, and a power heirarchy where some are above the law and others are not.

It is better to have no law than to fail to enforce it or selectively enforce it. In this way the law can’t be used against the average Joe citizen as a show of power.

And I’m guessing the ‘medical conditions’ are the women are all pregnant and LGBYQ in the mix.

They shouldn’t face charges. They were just dumb pawns. The people who should face charges are the organizers behind it, which was a coalition of various groups, including everybody from George Soros to the Quakers (who were particularly involved) and other liberal religious organizations.

If it were up to me, all it would cost is rope. Hang them on the side of the wall facing Mexico. If one thinks that is cruel, these punishments (and worse) for minor crimes, are carried out in muslim countries.

Just because an individual is persuaded to break our laws by a third party, does not mean the lawbreaker should not be prosecuted. But certainly, that third party is also culpable.
