U.S. court rules for Trump on transgender military limits

WASHINGTON (Reuters) - In a legal victory for U.S. President Donald Trump’s administration, a federal appeals court on Friday threw out a lower court ruling that blocked a policy barring certain transgender people from serving in the U.S. armed forces, which the government said is important for military readiness

The victory is limited. Although the appeals court sided with the administration, other federal courts issued injunctions against the policy, which applied nationwide. The administration already has asked the Supreme Court to weigh in on the issue. The high court is due to consider whether to hear three separate government appeals at its private conference on Jan. 11.

The various injunctions allowed transgender troops to join the ranks as of Jan. 1, 2018.

Trump announced on March 23 that he would endorse a plan by former Defense Secretary Jim Mattis to restrict the military service of transgender people who experience a condition called gender dysphoria.

The policy replaced an outright ban on transgender service members that Trump announced in July 2017 on Twitter, citing concern over military focus and medical costs.

The three-judge panel said in an unsigned opinion that District Court Judge Colleen Kollar-Kotelly was wrong to conclude that the new restrictions were essentially the same as the original ban, which she had also blocked.

When you look at Judge Kotelly's ruling against the military transgender ban combined with how the FISA court allowed the surveillance of President Trump on the basis of the phony Steele dossier, the FISA rulings do not look dumb, they look deliberate.

Treating the mental disorder gender dysphoria with surgeons knife should be not only malpractice but felony disfigurement. Why, in this country, are we so adverse to mental health problem recognition and treatment.

The military justice system (UCMJ) exists because active duty military members give up various rights when they leave the civilian world.

For example, while living on base, military police can search your room, car, or person with a warrant.

You don’t have a 12 member jury of your peers when up for a court-marshal.

You can be questioned without an attorney present and Miranda rights don’t apply to you.

And most importantly, you can be ordered to do something that is dangerous to your health, safety, life, on pain of death (not done anymore) or prison time. (This is why I’m annoyed when police call non-police “civilians”.)

Given this fact, its plain to see that the rules for the military are different than the rules outside of the military. You know this going in. You want to live by civilian rules and take advantage of all the benefits offered in the civilian world...don’t join the military.

This is why I chose not to join the military. I couldn’t even keep hitting the button during the hearing test. I’d have gone awol for sure the first time some dimwit Drill Sgt told me to do something I thought was stupid.

Correct. Of the policy/political errors that Trump has committed, subjecting himself repeatedly to courts that have no jurisdiction is undoubtedly the most egregious. When the first District Court judge out in kalipornia or hawaii or wherever struck down his immigration policy he should have gone out THAT DAY to the press room and thanked the judge for his advisory opinion but since the judge had no jurisdiction, POTUS was not bound by it.

Now THAT would would have been swamp draining par excellance.
