Yunsong Zhao: Charges Dropped on Obscure Rifle law after  Eight Months in Custody

On September 24, 2018, Yunsong Zhao was vindicated. He had done nothing illegal. The evidence against him was so weak, the judge did not let the case go to trial. He dismissed the case based on lack of evidence. From wsls.com:

CHRISTIANSBURG — A judge on Monday dismissed the firearms charge against former Virginia Tech student Yunsong Zhao, saying that he didn’t believe the police officer or gun dealer who were the prosecution’s main witnesses.

The evidence that Zhao, a 20-year-old Chinese national, possessed an assault weapon that is allowed only for U.S. citizens or permanent residents was too flimsy to let a jury even consider a conviction, Montgomery County Circuit Court Judge Marc Long said. Zhao, who has been locked up since his Jan. 29 arrest, had faced up to five years in a Virginia prison if found guilty on the gun charge.

Zhao grinned and clasped his hands after Monday’s dismissal — then was returned to the custody of federal immigration authorities.

If Zhao had been a citizen or a permanent resident, he would have been released at that point. But Zhao was in the U.S. on a student visa.

Zhao had been charged with an obscure law making it illegal for a non-citizen to put a magazine that holds more than 20 rounds into a semi-automatic rifle. Zhao had legally purchased the rifle, which originally had 30 round magazines with it.

Let me guess: They are paranoid about another mass shooting happening, yet have done absolutely nothing in terms of security at Virginia tech, no armed security guards, no single entrance, no armed teachers, no armed anybody because nothing is more important than allowing another fish in a barrel shooting to occur so the left can have another reason to unconstitutionally infringe upon the 2nd.

That should be more than 20 rounds, not more than 30 rounds.

Here’s a better guess: The idea of a foreign national walking around armed with anything more than a pocket knife is preposterous.

There are exceptions in the law for non-citizen state residents who have hunting licenses or are members of shooting clubs.

Why shouldn't a non-criminal non-resident have the right to arms?

Ideally, President Trump would negotiate the same rights for U.S. citizens in other countries.

Since I didn’t know this was possible, I’d never thought of it before. My gut reaction is, this is bad. It allows lone wolf types to cause problems, assuming we don’t catch their radicalization, etc.

The argument (that I heard from Shapiro) about “subject to the jurisdiction thereof” as defining when you gain rights such as arms would apply to a non-criminal (non-illegal) non-resident, so I guess technically they do have this right...

As a Chinese national(that is allowed to study in the United States), he is probably well versed on how to handle a personal protection rifle both safely and efficiently...

There is a loophole on the ATF form that if you have a carry license you can buy weapons. I saw a british contractor buy a gun at the gunshop that way.

Not if the state issues a carry permit. Is why the shall issue clause in a sanctuary California like state is a scary thought.

Nine months in prison, then deported for an expired student visa.
