Vanity: Trump has Constitutional Power to Convene BOTH Houses of Congress
VANITY

Posted on 01/23/2019 1:14:47 PM PST by TigerClaws

He shall from time to time give to the Congress Information of the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient; he may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper; he shall receive Ambassadors and other public Ministers; he shall take Care that the Laws be faithfully executed, and shall Commission all the Officers of the United States.

Truman did this in 1948 against the "do nothing" (then Republican) Congress and it propelled him all the way to "Dewey Defeats Truman."

Good vanity. He can excuse both Chambers, and then Reconvene them.

I thought this was the case...must have read that old musty document at some point.

Call a joint session but since it’s not the official SOTU make Nancy sit with the rest of the rabble, not on the dias behind him. Maybe put Melania and Ivanka there, everyone would watch.

Or adjourn? I’d feel even safer than I do with the current “paralyzing” shutdown. (So, are people that are paralyzed offended when the msm uses that term?)

I just posted this on another thread.
Call Congress into a “special session” per THE CONSTITUTION.

Let me expand:

“...he may, on extraordinary Occasions, convene both Houses...”

(you must admit this is one of those “extraordinary Occasions”, government shutdown, border security, Speaker of the House REFUSING the president access)

Definition of convene

Don’t be confused with “being in session”. Convene defined below.

transitive verb

1 : to summon before a tribunal
2 : to cause to assemble

If the president calls on Congress to assemble, they have to go. He can summon them to any appropriate location. Doesn’t have to be the House Chamber, if they refuse to allow it’s use.

MAKE THEM attend a State of the Union address.

The trick is that the Senate has to adjourn and then when the House refuses to then President Trump, under Article 1, Section 3 can force the House to adjourn and then he can convene a joint session in the House an hour or so before the State of the Union.

Do a MAGA rally and have the Sergeant at Arms make them show up

Not likely. Nancy would file immediate suit in 6th circuit and judge would bar Trump’s action.

"If the president calls on Congress to assemble, they have to go. He can summon them to any appropriate location" such as Mar-a-Lago!

The Constitution says that the Kenyan from Indonesia can’t be President.

We lost it on Usurpation Day, January 20, 2009.

ALL of our elected and appointed participated in the violation of the Constitution.

From the constitution:

“Section 3
He shall from time to time give to the Congress Information of the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient; he may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper; he shall receive Ambassadors and other public Ministers; he shall take Care that the Laws be faithfully executed, and shall Commission all the Officers of the United States.”

It doesn’t say ANYTHING about calling Congress into “session”. The word “session does not appear here.

It’s about “convene”.
1 : to summon before a tribunal
2 : to cause to assemble

Calling Congress back into session should circumstances require it is what the clause is referring to. I highly doubt that convening both houses to listen to his State of the Union address is what the Founding Fathers had in mind when they specified ‘extraordinary Occasions”.

U.S. Constitution: The President “shall from time to time give to the Congress Information of the State of the Union, and recommend to their Consideration such measures as he shall judge necessary and expedient.” Article II, Section 3, Clause 1.

Words mean things in the constitution! Even punctuation as we know (commas).

So if they meant to call Congress into “session” they would have used THAT word.

They knew what “convene” meant! That’s why they used it!

Not SORRY!

Just reading elsewhere, that Trump is approaching the already extended invitation and his acceptance to deliver the SOTU in the HOR, as a CONTRACT. Hmmm.

We will see if this angle can work to get him into the HOR for the Address. Coupled with a right-to-convene, maybe DJT can also stuff this down Nancy’s chortle portal.

Well, we are told that 25% if the government is shut down for want of funds. What could be more extraordinary? An alliance to depose Maduro and Free Venezuela? Would the call for allied troops to invade be extraordinary?
