The Media Was Just Shut Out of the Roger Stone Case

Judge Amy Berman Jackson of the federal court for the District of Columbia on Friday placed a gag order in the case of Roger Stone.

According to Fox News, Judge Berman signed an order telling Stone he must "refrain from making statements to the media or in public settings that pose a substantial likelihood of material prejudice to this case." 

The judge also told witnesses and council to keep from making statements to the media or general public near the courthouse. The reason? The statements could “influence any juror, potential juror, judge, witness or court officer or interfere with the administration of justice.”

From the judge's order:

There will be no additional restrictions imposed on the defendant's public statements or appearances at this time, although this order may be amended in the future...if necessary. This order should not be interpreted as modifying or superseding the condition of the defendant's release that absolutely prohibits him from communicating with any witness in the case, either directly or indirectly. Nor does this order permit the defendant to intimidate or threaten any witness, or to engage or attempt to engage in any conduct in violation of [U.S. Code.]

Finally, while it is not up to the Court to advise the defendant as to whether a succession of public statements would be in his best interest at this time, it notes that one factor that will be considered in the evaluation of any future request for relief based on pretrial publicity will be the extent to which the publicity was engendered by the defendant himself.

Last month Stone pleaded not guilty to obstruction of justice, witness tampering, and making false statements to Congress. He was eventually indicted and taken into custody as part of special council Robert Mueller's Russia probe.

Well, we cannot have the defendant blowing holes in the lying media's narrative. It would be a crime if he had a fair trial in the District of Corruption. (DC).

I know a bit about the law, but his lawyers can’t talk to witnesses? That seems outrageous.

My understanding is Stone cannot issue statements on the courthouse steps, etc., but he CAN appear on Tucker Carlson, Hannity, etc., and talk all he wants.

Why has this Obama judge allowrd to be assigned to Manafort, Cohen, Gates and now Stone? Is she the only damned Federal judge around? She stonewalled the Benghazi lawsuit, the fast and furious gun running op...and now she’s on every single Mueller indictment!

Somebody, somewhere, sometime must call this so-called Judge out and make her explain just how the hell a DEFENDANT’S Speech “that poses a substantial likelihood of material prejudice to this case” is illegal.

It’s clearly an unconstitutional order.

Jackson, DC District Court, has stonewalled the House Oversight Committee’s subpoena for documents related to the U.S. Justice Department’s ill-fated Fast and Furious operation. She is yet another Harvard Law graduate in the ever-growing White House corruption scandal.

Tragically, U.S. border guard Brian Terry was killed in Peck Canyon, Arizona on Dec. 15, 2010 by an AR-15 assault rifle. This weapon was part of a cache of weapons trafficked to Mexican drug cartels under Fast and Furious. Mr. Terry’s family has been stonewalled as well.

I really hope he challenges this ruling. Someone has to. This is so blatantly unconstitutional, a violation of the 1st, 4th, 5th and 6th Amendments at least.

A federal judge in Washington has dismissed a lawsuit alleging that Hillary Clinton’s lax security surrounding her emails led to the deaths of two of the Americans killed in the 2012 attack on the U.S. diplomatic compound in Benghazi, Libya.

In a ruling Friday, U.S. District Court Judge Amy Berman Jackson tossed out the wrongful death claims as well as allegations that Clinton essentially slandered the parents of the deceased by contradicting accounts the parents gave of events related to their children’s deaths.

Jackson also contributed $1,000 to Clinton’s 1992 Democratic presidential campaign and while previously working at a law firm, represented former Democratic congressman William J. Jefferson in a corruption trial, the Washington Post reported.

The Judge controls what can and cannot be said

The Judge controls what evidence can and can not be seen or heard

The Judge decides which witnesses can and can not be heard

What exactly is the purpose of the trial??

The media was not be shut out. It will continue to poison the jury pool while Stone will be unable to respond. Stone’s best hope is that his supporters will do the rebuttal that he cannot. Anyway, it’s time for Congress to resign in judicial restrictions like this. And Trump should pardon Stone.

Stone can’t do that. He is already bankrupt. He sent me email saying he had to move into a small apartment. Next raid on his home will disturb many renters.

The summary of the order in this article is not correct.

Stone himself and the attorneys are (presently) only prohibited from making statements about the case in or outside of the courthouse, where jurors may be present.

The attorneys (but not Stone) are prohibited from making “material misrepresentations” (whatever that in actual practice means) about the case.

We wouldn’t want the defense to influence any potential jury pool by making statements to the media. As for the prosecution, “Mission Accomplished” thanks to an assist from CNN.
