Sandy Hook lawsuit against gun maker Remington can proceed: Court

The Connecticut Supreme Court on Thursday said a lawsuit challenging how Remington marketed the rifle used in the December 2012 Newtown school shooting can proceed, overturning a lower court’s outright dismissal of the case.

In a 4-3 opinion, the court narrowly ruled that families of victims of the Newtown school shooting can challenge whether Remington violated trade practices in how it marketed the AR-15-style rifle used in the shooting.

“The regulation of advertising that threatens the public’s health, safety, and morals has long been considered a core exercise of the states’ police powers,” Justice Richard Palmer wrote for the majority.

The case had been closely watched by advocates on both sides of the gun issue.

It marks another case involving a 2005 federal law that generally shields gun makers and manufacturers from liability for crimes committed involving their products. Courts have dismissed other similar wrongful death lawsuits on those grounds.

Does Ford or Chevrolet or BMW or Dodge get sued when a person driving a perfectly good car kills someone by hitting them?

Cause it makes just about as much sense.

What if someone uses a Louisville Slugger? Or a Gillette razor?

Does (or should) Wells Fargo have liability when a pipeline company they owned money to has a leak on their pipeline? (AOC questioning of yesterday).

To answer your first question, no they don't. The reason is that, at this point in time, the powers that be are wanting to disarm the public. At this point in time they want to get guns out of the public at large, not vehicles. They will go after vehicles after they get the guns.

The answer to question number two is, true, it does.

The same answer to question one applies to questions three and four.

There is a concerted effort on multiple fronts to disarm the American people.
