Trump-picked 9th Circuit judge clears last hurdle to confirmation, with more nominees in pipeline

Another of President Trump's nominees to the San Francisco-based 9th Circuit Court of Appeals cleared a key procedural hurdle in the Senate on Monday, as the White House continues its push to transform the key left-leaning appellate court that the president repeatedly has derided as hopelessly biased and "disgraceful."

By a 77-20 vote, the Senate invoked cloture to end debate on Trump's nomination of Arizona-based Magistrate Judge Bridget Bade, a former clerk to conservative 5th Circuit Judge Edith Jones. Bade is slated to replace Bill Clinton-nominated Judge Barry Silverman, who has been on senior status since late 2016 -- effectively judicial semi-retirement. ... With its lack of fireworks, Bade's confirmation process has stood in stark contrast to that of Seattle attorney Eric Miller, who was confirmed to the 9th Circuit last month in a 53-46 vote. In a historic snub, the White House ignored the input of the judge's two Democratic home-state senators in picking Miller, whom progressives attacked as a corporate lawyer and Federalist Society member whose career supposedly had been hostile to Native American rights.

I did a quick review of the current judges sitting on the 9th Circuit of Appeals. All 9 of the Clinton appointees are eligible for retirement/Senior Status under the “Rule of 80” and all but one of the 5 Bush appointees are also so edible. The rule of 80 allows retirement (or Senior Status) AT FULL SALARY when the addition of age and years of service equals 80 or more.

Judge Bade’s confirmation vote should be tomorrow. In addition to the vacancy she fills and the other four existing vacancies, President Trump may have more opportunities to help shift the Leftist Lock of the 9th Circuit of Appeals — but ONLY IF HE AND CONGRESS IGNORE THE BLUE SLIP VETO that the ‘RATS employ so effectively.

The rule of 80 allows retirement (or Senior Status) AT FULL SALARY when the addition of age and years of service equals 80 or more.

That’s a very nice retirement. A federal district judge earns a salary of $208,000 and a circuit court of appeals judge earns $220,600 per year. Whatever earning potential is forfeited during a federal judge’s years on the bench is repaid handsomely in retirement.

Yes, at the Circuit Appeals Court level but not for District judges. The 9th circuit is loaded with crappy District judges since the ‘RATS have used the blue slip process to insure only “acceptable” (to them) nominees make it to confirmation votes.

the White House continues its push to transform the key left-leaning appellate court
Filling vacancies on the federal bench is a duty and responsibility of the President. I don't ever remember the MSM referring to this duty as a "push to transform" under previous administrations. The only "push" is the push to overcome obstruction, and that has occurred in the Senate, not the White House.

Trump has three more 9th Circuit appointees awaiting confirmation:

Daniel P. Collins who will replace Pregerson
Kenneth Lee who will replace Reinhart (who is dead)
Daniel Bress who will replace Kosinski

There is also O’Scannlain’s open seat that has yet to receive a nominee.
So if he gets all this through, that will be EIGHT new Justices on the 9th.
He three confirmed appointments replaced TWO Bush appointees and ONE Clinton.

So Clinton/Obama=16, Bush/Trump=13 And that is really leveling the playing field.
The remaining Clinton judges range in age from 64 to 73. Just hope there are no Ruth Buzzy Ginsberg’s in the lot and that a few more of them retire. Obola’s appointments run from 2011 thru 2014, so unless they get hit by a car, they’re there for all of Trump’s hopefully two terms.

It certainly will be nice to restore some dignity and a sense of measured justice to the 9th Circus court of appeals. It’s been known as a circus because of all the super knee-jerk liberal judges, who made a laughingstock of court justice.

Unfortunately, that's true of almost all Trump's District Court nominees.

44 of Trump's 53 nominations for District Court have been approved by voice vote or with minor opposition.

I don’t know; maybe that’s the best they could come up with in Hawaii? Fortunately he’s at least 20 years older (they were born in the 1970s) than Trump’s other two appointees sitting on that court. Trump can’t waste a single Circuit Court judgeship on a “squishie” nominee IMHO.

Clearly, Trump has had success installing other Conservatives in the Ninth Circuit.

Why would Trump nominate a Circuit Judge who was supported by EVERY Democrat in the Senate?
