Bill to outlaw abortion in Tennessee if Roe v. Wade is overturned advances

NASHVILLE, Tenn. (WVLT) -- Both chambers of the Tennessee General assembly voted to approve a so-called "trigger law" that would outlaw all abortions in Tennessee if the supreme court rules to overturn Roe v. Wade.

No exceptions are provided by the bill for victims of rape or incest. The only abortion that would be legal in the state would be allowed in circumstances involving "substantial and irreversible impairment of major bodily function."

As important as abortion is, its not just Roe V. Wade that is part of this debate.

The Warren Court in the 60’s radically turned the Constitution into a “living document,” in the famous phrase of William O. Douglas”. “specific guarantees in the Bill of Rights have penumbras, formed by emanations from those guarantees that help give them life and substance.”

In sum, the court can impute any rights it wants. “Privacy” means killing one’s baby and “equal protection” means men can use women’ bathrooms.

This extremist view of the Constitution needs to change first before Roe V. Wade will change.

IMO, the only way a single case will be overturned is via a majority of votes; it is almost certain those votes will not occur until, as PGR88 urges, the view changes.

Unfortunately, it is also almost certain "the view" will not change until new justices are brought on, and that can be a slow process.

J. Kavanaugh was the tipping point. Conservatives now enjoy a slim majority. When Justice RBG goes to the big reeducation camp in the sky, there will be a slightly fatter majority. With any luck Souter and Roberts will be getting longer in the tooth soon, too. And so on and so forth. All Trump needs to do is win one more POTUS election, and help the Republicans win one more mid-term after that, and SCOTUS will be that much better.

Don’t worry, millenial sleep-arounds. If Roe is overturned, you’ll still be able to kill your babies — you’ll just have to do it in an abortion state.

You are correct, of course, and every leftist on the globe, especially those within our country, will work to defeat that possibility.

I am an optimist, but being a certified risk-taker try to keep my head on a 360 lookout for threats.

Trump is the ultimate risk taker. He’s got his head swiveling 360 and in a 180 vertical arc within those 360 degrees as well. It helps that the enema believes itself supremely smart and him incredibly stupid, and that the enema is so predictable. But we can’t rely on their clueless-ness as a given. Even a stopped clock is right twice a day.

The effects of overturning Roe will be a little more complicated than appear on the surface, that abortion will simply be up to the states as it had been before.

Sadly, most states have become inured to the abortion culture over the decades, and even if they had criminalized it prior to 1973 will just continue to allow it if Roe is overturned. States which want to again criminalize it are apt to run afoul of recalcitrant leftist judges, who have no compunction about lawless decisions unless a conservative superior court puts their foot down.

It's more likely that most states will simply scale back allowances for abortion to something that they've been trying to achieve more recently: 20-week or "heartbeat" bans, hospital admittance requirements for doctors, surgical clinic standards, public funding denials, etc.

And more than likely, a "conservative" court will probably temper a decision to split the baby, giving each side a concession, not rule decisively based on principle, as they used to.

Color me hopeful but extremely unenthusiastic. This is going to get the “Trump wall” treatment if it actually goes into effect, will be disobeyed on a tremendous scale, and no cop in the land is gonna want to be the first to arrest anyone for breaking it.
