Kavanaugh and the Crisis of Legitimacy

It is impossible to separate the latest attack on Justice Brett Kavanaugh from the political strategy of the Democratic Party. On September 16, two days after the New York Times "Sunday Review" section told of another allegation of sexual misconduct during Kavanaugh's college years, "Axios AM" described Democratic plans "to portray President Trump, Justice Brett Kavanaugh and Senate Majority Leader Mitch McConnell as the three villains defining the three branches of government for the 2020 campaign." The reasoning: "Each of these white men, they will argue, symbolizes Republican corruption and rule-bending.”

Because opinions of Trump do not change, the Democrats have decided to rally their base against the two other "white men." That is why all of the major Democratic presidential candidates except for Joe Biden and Amy Klobuchar called for Kavanaugh's impeachment after the publication of the Times essay. It is why the media gave the accusation, heard by reporters second-hand, saturation coverage. And it is why Ayanna Pressley, member of the Squad, introduced a resolution to start an impeachment investigation

The crisis of legitimacy is in the elections putting the demonicrats in office. Killary got millions of votes form illegals, the dead, and boiler rooms filling out ballots. She is just the tip of the iceberg.

The Kavanaugh controversy is really a proxy for the battle for the rule of law. The Supreme Court and Kavanaugh are proxies in that battle, a battle in which the left seeks to do away with more than the distortions of the Constitution which they have already achieved.

They seek to substitute a whole new paradigm which has nothing to do with the Bill of Rights, limited, enumerated and separated powers, checks and balances, or the primacy of the individual over the collective.

So in attempting to destroy Kavanaugh, they are by extension destroying legitimacy of the Supreme Court and with it the rule of law. Certainly our fundamental founding documents. They are coming ever closer in their nihilism to their goal of systemic destruction. The closer they take us, the closer the breakdown of society into either a Hobbesian jungle or Civil War.

That is because the politics of personal destruction IS the political strategy of the Democratic Party and the Left in general.

It’s extremely pragmatic. They are making the case and rallying the troops for rescinding the filibuster and Court-packing - expanding the Supreme Court and Courts of Appeal by at least as many justices and judges as Trump appointed.

Apparently destroying people is no big deal to a Democrat, as long as it gets them back in power.

This one failed. They have other whores ready and waiting to collect their tax free stipend as soon as they release their story about Trump.

If Trump gets to nominate someone for the Supreme Court, they have a few hookers ready for that. If it’s a woman, they will have to be more creative.

It’s funny. When SCOTUS rules in a way they like, say abortion or gay “marriage”, it is as though the ruling has come from God Himself and cannot be questioned. It is “settled law”. But if it rules or even threatens to rule in a way displeasing to liberals, then SCOTU is “sick”, politicized, and in need of correction.

When Republicans put justices on the court the test should be, and generally is, are these jurists originalists? In other words will they apply the Constitution as written and understood?

When Democrats put justices on the court, the test is will they rule in line with Democrat party doctrine? As a result the four leftists on the court are utterly predictable on every social and political issue.

Worse, the court has become an extraconstitutional, undemocratic instrument of Democrat social policy and it has increasingly been perceived to be so by the nation. As the perception increases the legitimacy of the court decreases.

As the court squanders its legitimacy, the rule of law is undermined.
