There need to be Federal laws against SDNY holding any power outside their jurisdiction, or have those powers transferred to the Heartland.

I’m guessing the taxpayers aren’t paying for their lawyers. Otherwise, every CIA agent would have an entire law firm on retainer from the moment he walked through the door for his first day on the job.

No criminal Democrats are going to prison because nobody in the DOJ will prosecute them to the benefit of Donald J. Trump. That is as sure beltway career ender as there is. It’s been 15 months since McCabe was referred for non coup related prosecution. And what has happened? Nothing.

The alternative is what we had before FISA, right? The government can snoop for foreign intelligence, and does not need a warrant to do so. FISA was passed so evidence uncovered while snooping for foreign intelligence could be used to prosecute criminal activity. The Keith case is what triggered FISA - was a prosecution of a bomber operating in the US. The government didn't bother to get a warrant, and argued it didn't need one.

When the case is REALLY spying, no warrant is needed, period. Aldrich Ames house was tossed, no warrant, no issue either. How the F.B.I. Finally Caught Aldrich Ames. Post-FISA, for what it's worth.

LOL. FISA has "strict controls," and the real upshot of FISA is a make work to the order of millions of dollars worth of lawyers and judges. Stacks of paper nobody will ever refer to. Total waste. Shut it down.

The government is always going to snoop on its citizens to the extent technology facilitates. The law has no effect against the government.

A secret court where only the government is represented is un-American.

Regular federal courts are sufficient for the FBI to get search warrants. If Federal Courts are insufficient for this, how is a secret federal court more trustworthy?

Remember, we never needed a secret court during the original cold war and we conducted deadly serious investigations.

Secret courts are un-American.

The damage from widespread pervasive spying on the the American people has done far more damage than any activity conducted by some US citizens. (citizens who could easily be pursued under the regular criminal justice system anyway)

Rushed? It’s been 3 1/2 years since these Democrat crimes. There is almost exactly 1 year left in the first term of POTUS. Mueller jailed Trump supporters in little more than months. Those are the facts. Sorry.

"Technology allows" is counter to "citizens allow." The only time unconstitutional snooping by the government is enforced is in criminal court.

Citizen objection has no advance power in the calculation.

I followed the class action suits based on bulk surveillance. The suits were consolidated into one big class action, eventually dismissed (9th Circuit) on state secrets grounds.

I know of no case where a government actor was punished for illegal surveillance, but admit to not having done more than 10 hours of research in that specific direction.

The target never gets an advance view of the process used to get a search warrant against him.

The only time the target is aware of the snoop is if and when the evidence is introduced in a criminal trial. Warrants THEN become a matter of public record, unless the judge seals the warrant, which is actually very common.

That said, I agree with you that FISA is a sham and a waste.
