Flynn Expects to Ask Judge to Dismiss Case Against Him, His Lawyer Says

Lt. Gen. Michael Flynn, a former adviser to President Donald Trump, expects he will file a motion asking a federal judge to dismiss the case against him, said Flynn’s lawyer, Sidney Powell, in an Oct. 24 court filing.

The development marks yet another twist in the story of the intelligence professional whose accomplished life was turned upside down after he agreed to become Trump’s national security adviser.

Flynn pleaded guilty on Nov. 30, 2017, to one count of lying to the FBI. He’s been expected to receive a light sentence, including no prison time, after extensively cooperating with the government on multiple investigations.

The Washington Examiner has an article with embeds to the government’s response to Powell’s 160 page grenade. Mostly they throw back to “Flynn pled guilty”. Of more concern is there claim that rules of procedure do not allow bringing up new issues in the type of brief Powell filed. That is likely why Sullivan ordering the surreplies. We shouldn’t become confidant to justice — the courts and the swamp might find ways to subvert it yet.

Jessie Liu replied separately to say that the Mifsud phones have nothing to do with Flynn’s case, and they ain’t producing them. One wonders how exactly Jessie Liu knows the full content of those phones.

I know there are different views among all well intentioned people, but I would never plead guilty to anything I am not actually guilty of.

I would rather them claim I am guilty and find me guilty and throw me in jail, then to “plead” guilty and then be at their mercy and the public’s mercy. I know his family was being financially ruined by this, but they can find you guilty with or without you having the best lawyers available.

If God puts me in jail, then I will be preaching to the convicts, keeping myself busy while God works His plan.

Yes they might, I don't have a lot of confidence in "courts" from top to bottom.

Judge won’t dismiss this. Flynn needs to be railroaded so the democrats can use it when they reintroduce the Russia collusion in their impeachment articles. You can bet that they aren’t banking everything on the current Ukraine issue.

His family was threatened with much more than that. Mueller and his demons were going to imprison Flynn's son, leaving Flynn's 1-month-old grandchild basically fatherless.

That was the leverage, and it worked.

if Flynn ever got a long sentence, (and I realize that he won’t and of course should not get anything) he would be perfectly justified to defend himself to the end against any federal forces if he chose to do so.

IMO, in the case and many others, the feds are so evil and morally bankrupt that their victims could justify any action taken against them.

The rule of law is meaningless when it is conducted by evil people. Remember, Hitler, Stalin and Mao never broke any of their nation’s laws.

Why doesn’t Trump just pardon this man. It goes on and on, he’s financially ruined, and now there is proof that the messed with the 302’s. This should be HISTORY by now.

Every single one of you are 100% correct. No one knows, they will destroy the family into prison with me, forced confession, etc.

But that has happened in history before, and a small confession, or sprinkling a little incense on an altar, or promising not to preach about hellfire and brimstone, and all of this goes away.

It actually never goes away, the first time you agree to their demands brings a second time, and the face in the mirror becomes more and more like the people doing the threatening.

Many, too numerous to name, men and women have been threatened like this in the past, they refused to bow or bend the knee, and history eventually vindicates them. And God has and will vindicate them.

I would rather stand for right, no matter the cost. And I do not agree with the statement, “no one knows what they will do.” If you inure yourself to hardship, if you train up yourself and your family to do what is right, no matter how small or the cost, you will KNOW what to do in that day. Whether you do it or not is your choice, but we have the power to do right within us, if we follow the one who set the standard.

He will, but not right away.

There is still a reasonable probability that the court will will dismiss for the failure to divulge exculpatory evidence and that same court will fear review on appeal the procedural error of failure to enforce discovery of that evidence.

A dismissal or reversal on error will paint the prosecutor and cops as dirty and can be used against the coup plotters.

Worst case scenario, Trump can fully Pardon Flynn just before he leaves office, as the Pardon would be used to paint Trump and Flynn as dirty.
