Dem’s only get a choice over house hearings.
Dem’s don’t get a choice if it’s the Department of Justice that prosecutes.
Dem’s don’t get a choice in Senate Hearings. (Although I’ve heard they might given current Senate rules but Republicans could change the rules.)
Dem’s don’t get a choice in a Senate trial if they are stupid enough to send articles of impeachment to the Senate.
