First Red Flag Conviction In Florida After Man Refuses To Give Up His Guns

A man from Deerfield Beach, Florida, faces a potential of five years in prison after being convicted for defying the state’s “red flag” law, which allows authorities to confiscate weapons from those deemed to be at high risk of committing a crime. The case is the first conviction under the state’s relatively new gun law, which was passed in part as a response to the horrific mass shooting at Marjory Stoneman Douglas High School in Parkland, Florida.

Since the red flag law went into effect in March 2018, Florida has seized guns from over 2,000 residents of the state. But while the state has taken thousands of weapons, it has not convicted anyone for violating the law — until this week. As reported by the Sun Sentinel, after being charged in March 2018 under the law for refusing to hand over his firearms, Jerron Smith, 33, was convicted by a Broward Circuit court this week on charges carrying as many as five years in prison.

I hope this man has the strength support and character to appeal this to its limits.

Our constitutional rights are not waiveable because some tom dick or harry alleges something.

I read this last weekend. This guy is a definite candidate and was justly separated from his guns. What I’d like to know is why he wasn’t in jail to begin with after spraying his friend and car with gun fire.

The guy is an idiot and should be in jail.

Shooting up a friend’s car is not the act of a model citizen.

However the idiots we have in our legislatures always do something to make matters worse.

The guy should be jailed for shooting up the car, and it should be a multi year stay in prison. Passing a law with vague or fuzzy limitations only serves to make it possible to be used on innocent victims.

In other words, the cops already had a law on the books that would punish the guy and evidence (damage to the vehicle) to make a solid court case.

The law is open ended. The state can take anyone’s guns. The state can have officers whose job is just to say that they think this citizen or that one might commit a crime or kill himself.

No one was hurt when he was shooting at that moving car we the news media does not tell us what kind of cell phone he was shooting over.
