We Have a Constitution Not a King: Cuomo Rejects Trump's Claim of Total Authority to Lift Shutdowns

New York Governor Andrew Cuomo has rebuked President Trump's claims that he has blanket authority to order a reopening of the country. In a heated press conference inside the White House on Monday evening, Trump asserted that his office holds 'absolute power' over the shutdowns But Cuomo said later Monday that the last time he checked the US had 'a constitution...not a king'. The governor went on to accuse Trump of an 'abrogation of the Constitution', before threatening the president with a lawsuit should he put New Yorkers at risk. 'The close down was left to the governors to do individually state by state. Now the reopen should be total authority? That makes no sense,' Cuomo said. In a heated press briefing, Trump launched a furious attack on the media and screened a White House-produced video praising his response to the virus.

I'm somewhat confused. When Obama made the statement he "doesn't need to wait for Congress to change laws, he has a pen and a phone", I don't recall hearing a peep out of the liberal left....just sayin'.

Trump can declare ANY business essential to the national defense and order it opened under the NDPA.

Democrats were the ones who insisted he invoke it.

I have no problems with the states deciding on their own to open up.

The smart ones will begin to loosen the choke hold once they have a good handle on things. One size fits all does not work in this case.

Let the blue states suffer while the red states start getting back to work.

Earlier Monday, six governors from states on east coast and three on the west coast announced their own pacts to come up with a framework on how and when to reopen.

All nine governors are Democrats and include Gavin Newsom of California and Andrew Cuomo of New York - both of whom have seen their ratings soar during their handling of the crisis.

Pointedly, the governors on both coasts said that ‘public health’ was their leading priority.

But they put themselves on a collision course with Trump, who hyped his proclamation that he would decide on Twitter, after saying for days it would soon become time to ‘reopen’ the U.S. economy.

The president’s emphatic statement came as it was revealed his task force on the vital matter will include cabinet members, his daughter and his son-in-law.

‘A decision by me, in conjunction with the Governors and input from others, will be made shortly!’

Perhaps Cuomo is correct on this. However the President does have the authority to end the emergency which gave the states (and cities) the perceived power to force house arrest on their citizens, as well as cut off emergency funds.

Add to that the fact the people are growing tired of all this and may began mass civil disobedience.

Cuomo is playing a game where no one knows the rules and only time will tell which hand is the winner and which is the loser.

I am wondering if Trump isn’t using reverse psychology on the mentally defective dims?
He tells them they can’t and they do the opposite...just to show him who really is the boss. :)

Me thinks Cuomo is setting himself up as potential Dem Presidential candidate and nothing more. Biden has already sworn a female running mate, so Cuomo is out there. BUT, creepy Joe has some sex assault stories popping out of the woodwork, so someone must be ready to take his place! Surely Cuomo believes he is that man!

Democrats and the media (I repeat myself), fail to once again see how Trump is playing 4D chess here....while in one breath they argue that it is all Trump’s fault he didn’t shut down the country sooner, they are running around telling everyone that decisions to open (and close btw), are the Governors responsibility alone.

i.e. its all Trump’s fault that states didn’t get shutdown, but its not Sorry Dems, you don’t get it both ways. If it is not Trumps power to open the states, then it was never in his power to force them to close.

iN NY, that blame rests squarely with Cuomo and deBalsio.

If Trump says to start your engines, governors will be hard pressed to keep things locked down. There aren’t enough police in the world to keep NY locked down if Trump says, “Go!”

The bad thing is that everything that happens after that, including cloudy days, will be blamed on Trump.

Meanwhile, check out the UK homepage. It has citizens of the country that survived the Blitz and Hitler too scared to come out of their WuFlu foxholes when given the all clear. They’ll have to be coaxed.

My God, they don’t make Brits like they used to.

I am VERY confused. We are now being told that Trump waited too long to shut down the country (and the Demoncrats are going to investigate). On the other hand, we are also being told that he doesn't have the authority to re-open the country (that belongs to the governors).

The authority to shut down is the same as the authority to open. He either has the authority or he doesn't.

Speaking of Cuomo: Maybe he’d like to explain why the secrecy behind the conference call with a nursing home in Steuben County, the facility with the huge death toll attributed to WuFlu. The call that reportedly kept local officials out of the loop?

Couple of points, the US Constitution declares states cannot, w/o congressional consent, enter into compacts etc...

Interstate commerce clause, for once, may be applied properly.

Just because the POTUS gave states discretionary authority to declare appropriate levels of emergency, does not mean that he does not hold authority to change that delegation.

Finally, let the states move as they choose, and then use thier decision making as cause for any further complaint for monies to recover economically....

I find it rather ironic that the man who acted as a king and mandated everything (practically) be shut down is saying we do not have a king.
