Coronavirus shutdowns ordered by governors and mayors are unconstitutional

The governors of all 50 states and the mayors of many large cities have assumed unto themselves the powers to restrict private personal choices and lawful public behavior in an effort to curb the spread of COVID-19.

They have done so not by enforcing previously existing legislation but by crafting their own executive orders, styling those orders as if they were laws, using state and local police to enforce those so-called laws and – presumably when life returns to normal and the courts reopen – prosecuting the alleged offenders in court.

It is hard to believe that any judge in America would permit a criminal trial of any person for violating a standard of behavior that has not been enacted into law by a legislature.

Sadly a lot of people in my home state are scared of challenging our governor and the mayors lock down policy or even silently accepting the lock down policy even if the citizen knows it would harm small businesses.

It would have been more useful if the Judge had made this claim many weeks ago. Also, he makes light of Trump's way of making his intentions known. Having the DOJ take the tyrants to Court is exactly the right solution.

When the Supreme Court rules, the people will be quite prepared to tell the Governors who is boss.

People don’t even know what is says, not even those sworn in under it or sworn to defend it.

Every single one of the Bill or Rights has been abridged. Name me one single right that we still have where government hasn’t made a small astrix and redefined for us what right we actually have, when it applies, to whom it applies, where it applies, and what license you need and how much it will cost for you to exercise your “constitutional right.” Just give me one of the 10 that still stands today?

You have laws in blatant contradiction of the most BASIC ideas explicitly expressed in the Constitution and no one in the judicial, legislative or executive branch has taken action to end this for years, i.e. FISA, Patriot Act, free speech zones, gun free zones...

When I hear someone mention the US Constitution (it’s become seldom) I just want to laugh.

I hope so. The last thing I want to hear is governors and mayors telling everybody “We can suspend the constitution when ever we like” out loud and the news media still siding with the said governors and mayors, especially if it will make Trump look bad.

Back when governors and mayors were shutting down their states and cities and when lock down/stay at home order was justified, I remember people supporting the lock down were saying that the 10th Amendment “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people” was a valid reason for governors and mayors to lock down their jurisdiction.
