It wasn't just religious liberty that Chief Justice Roberts strangled
The Hill ^ | 06 02 2020 | Andrew C. McCarthy

SNIP

Close to midnight on Friday, while rioters used the killing of George Floyd as a pretext to set America aflame, the U.S. Supreme Court issued a 5-4 ruling that declined to enjoin the states of California and Illinois from restrictions on communal worship imposed due to the coronavirus pandemic.

Most startling was that Chief Justice John Roberts not only joined the court’s four left-leaning justices (Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor, Elena Kagan) in declining to uphold religious liberty. Roberts also wrote a brief opinion explaining his decision.

That opinion is an eye-opener. Roberts accords the right to worship no deference by virtue of its being a fundamental liberty expressly protected by the First Amendment. We are to see it as an activity like any other activity, commercial or social, the pros and cons of which technocrats must weigh in fashioning regulations. The opinion, moreover, champions the power of government officials to dictate to the people who elect them without “second-guessing by an unelected federal judiciary” — exactly the power that the Bill of Rights, and the incorporation jurisprudence by which the court has applied much of it to the states, are meant to deny.

This is truly remarkable because it is so gratuitous.

To think that this nation was founded by people seeking religious liberty.

There has been a lot of “progress.”

Is the word “technocrat” in the Constitution???? I see nothing in the Constitution about enabling technocrats to write government regulations that are able to nullify our God-given rights embodied in the Bill of Rights!!!!! If he put on a skirt he could pass for the tyrant Gov. Whitmer.

can somebody please tell me why Roberts could be blackmailed?
There is always someone on these threads that say “he’s blackmailed” but when i ask why, the response is very vague.
Please don’t say he’s gay, because nowadays that’s a resume enhancer.
Thank you!

“Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor, Elena Kagan”

Not one of whom has any ancestor in the original Colonies

So why would they give a damn what some yellowed piece of paper says?

Nobody in their families ever had a dog in the hunt.

No need to look for blackmail. Every law school is so screwed up that Roberts does indeed qualify as a ‘conservative’ among today’s legal profession.

Please there is no “right to worship”. Frame it that way and it does indeed become just another activity people have a “right” to engage in such as shopping, fishing, walking, and a host of other activities which can be limited in various ways by government edict.

What we have is the First Amendment, which spells out that we have free exercise of religion. That goes way beyond just being allowed to pray and worship together. That “free exercise” clause means the government does not grant us a “right to worship.” It means practice our faith by nature of our freedoms without government approval or restriction except for in very, very extraordinary instances.

This could force churches underground. Maybe people will return to worshipping in the manner of the early saints in the Book of Acts. Gathering from place to place, breaking bread and wine. It would remove the professional pastoral class that has bastardized worship from an interactive community experience to a one-man show. He who wields the microphone commands all the attention.
