Scott Circuit Judge grants statewide temporary restraining order against Gov. Beshear

(LEX 18) — Attorney General Daniel Cameron announced on Thursday that a Scott Circuit Judge ordered Gov. Andy Beshear to cease issuing or enforcing executive orders related to COVID-19 unless the orders meet specific criteria for an emergency as outlined by state law. The Judge stated that, in order to issue and enforce executive orders related to COVID-19, the Governor must specify the state of emergency that requires the executive order, the location of the emergency, and the name of the local emergency management agency that has determined that the emergency is beyond its capabilities.

“The Governor cannot issue broad, arbitrary executive orders apart from the requirements of state law, and the Judge agreed by today issuing a statewide temporary restraining order,” said Attorney General Cameron. “This is a clear win for the rule of law and will help Kentucky families and businesses across the Commonwealth who have suffered and continue to suffer financial losses and economic hardship because of the Governor’s executive orders.”

Attorney General Cameron joined the lawsuit last week, which challenges Gov. Beshear’s use of executive power during the COVID-19 pandemic and was filed by Agriculture Commissioner Ryan Quarles and Evans Orchard and Cider Mill, LLC, an agritourism business in Georgetown.

If a bunch of businesses got really good lawyers and sued the governor personally for lost revenue, this crap would stop real quick.

Indeed. These “state of emergency” orders are bull-crap. We basically do not have a functioning state government here in New Jersey. We’re being run by a dictator governor and no one is challenging him.

Our own legislature here cannot call itself into session outside of the regular sessions - the governor has to do that. And of course he hasn’t. There is no way for our legislature to meet to review these orders.

This is an outlier. Kentucky may have some sane judges, but California, New York, Illinois, New Jersey, Washington, Oregon, Colorado, and other states largely do not.

The governors have been able to run wild with their "executive orders", and now realize they can usurp the power of a dictator and no one will stop them.

They will never give the people their freedom back voluntarily.

How many times has President Trump and Fauci shared a podium or press conference in the last 4 months? Fifty times? Seventy times?

Back in March, Fauci told 60 minutes that mandatory mask mandates were WRONG.

Why didn't the President ever point this out?

Fauci's Deep State handlers got to him, and now he is just another Karen Mask Nazi.

Presidential tweets won't help. Hoping the courts step in won't help (and hasn't). State legislatures are paralyzed and powerless.

The only weapon we have to stop the muzzle slave mask madness is an Executive Order from the President that nullifies all of the state mask orders. Oh, the Marxists will challenge them in the courts. Let them. It's time to fight back against this oppression. If nothing else, do it for the elderly and children who are suffering under these muzzles.


But, I don't think it will happen. The President fears that if he does issue such an order, he will be further blamed for every COVID case, or he fears losing a court case here or there in specific states.

So nothing will be done to free us from this tyranny.

Sorta. Gov Beshear will ignore the order like all the others. His state police will gleefully go after people and businesses as they did earlier to stop church services.

The Kentucky State Police is corrupt from years of democrat control...much like the Obama holdovers in the Department of Defense and elsewhere.

If only we could obtain such a judicial ruling here in North Carolina. Lt. Governor Dan Forest recently filed a lawsuit attacking the procedural mechanics of Governor Roy Cooper's executive edicts as they relate to state law. At first glance, it's a solid attack against Cooper's lockdown overreach, but the judiciary is stacked with Rats and Forest waited too long to file.

Governor Karen Abbott of Texas had similar thoughts until the check cleared or he got his puppet strings pulled or just flat out peed his pants b/c of pumped up case counts.
