Contested Flynn dismissal to go before full appeals court as legal saga drags on (En Banc hearing granted!)

The dispute over the Department of Justice's move to dismiss criminal charges against former Trump national security adviser Michael Flynn will get a rehearing by the entire District of Columbia Circuit Court of Appeals, the latest twist in the long-running legal drama that stemmed from the FBI's investigation into possible collusion between the Trump campaign and Russia in 2016.

The order was issued Thursday by the court. Called an "en banc" hearing, all 11 judges on the appeals court will sit in on a rehash of arguments that were made before a three-judge panel in June, which led to a 2-1 ruling in favor of Flynn.

I knew this wasn’t over until 7 business days after an actual dismissal has been granted.

Even then... my guess would be Sullivan would try to retract his dismissal.

so lets play out the dog and pony show here.

Yes, Emmitt, the Snake, Sullivan contested the 3-Judge Appeals court decision to vacate the Flynn case. Now, the whole Appeals court came back and said...YOu GO Emmitt...get this bastard Flynn in prison!

Per the Constitution Congress determines the jurisdiction and parameters under which the federal courts below the Supreme Court operate. The GOP missed a huge opportunity in 2017 and 2018 when it controlled both houses of Congress and the Senate. It could have ended judicial tyranny in the lower courts by more tightly defining their jurisdictions as well as the powers of federal judges.

Of course Speaker Ryan and Majority Leader McConnell were too busy collaborating with Democrats to obstruct President Trump to undertake any meaningful reform of a judiciary that has been totally politicized and is infringing on the powers of the legislative and executive branch. Another example of the feckless do nothing party refusing to take action to stop the march of leftist tyranny.

Even if you indicted Comey Strok McCabe etc. who would convict them in DC?

Since when does a trial judge have standing to act as a prosecution advocate? They’re supposed to be unbiased in the courtroom. This just isn’t normally done. The judges on the full panel who thought it was a good idea to hear this appeal need to be removed for clear bias and terminal stupidity.

Trump has picked maybe one of those judges by my count - which could be wrong I hope. I skimmed through their bios quickly. Obama and Dubya judges.
