Queens Restaurant Files $2 Billion Lawsuit over NYC’s Indoor Dining Restrictions

A Queens restaurant filed a $2 billion lawsuit this week against Mayor Bill de Blasio (D) and Gov. Andrew Cuomo (D) regarding indoor dining rules.

“The lawsuit — which covers Il Bacco restaurant and ‘on behalf of all others similarly situated’ — argues the shutdowns unfairly and unscientifically impact New York City eateries and more than 150,000 restaurant workers who remain unemployed,” according to Patch.com.

Just Compensation Clause:
Clause in the Fifth Amendment to the United States Constitution that provides “nor shall private property be taken for public use, without just compensation”.

Eminent Domain:
The power of a sovereign entity to take or appropriate any land within its borders for any purpose that it deems necessary or beneficial.

I would think that forcing businesses to close up for 6 months or more just because the government deems it necessary or beneficial would fit into this area of the law.

Perhaps they don’t have provision for recall elections in New York.

Or perhaps with all the problems in that City, people do not connect it to their political leadership

About time! There is nothing in any constitution about the governor being able to say magic words and make themselves a dictator. The constitutions do not say, “...unless the governor says ‘State of Emergency’, then this document no longer applies at all.”

I would imagine so. A guy I know works as a contractor in a Democrat-controlled county. He’s very conservative. He’s also a registered Democrat. I once asked him why he registered that way.

“I need to get my building permits approved,” he said.

Note to every restaurant in the state: This ought to be a class action. Either you all hang together or you’ll go broke separately.

The way countries become commie hellholes is gullible people are told they’ll get something for nothing... or something they haven’t earned.

That lie can be handed to the young, to the greedy, to puffed up fools. But if you look around the world, you’ll see that lie has been effective. The people in those countries don’t get ‘the promise’ but they will get to live in a totalitarian hellhole.

That’s deBlasio’s secret weapon.

He promises the commie set of BS ... the power greedy, the lazy greedy, the evil greedy will keep him in office hoping against hope that THIS time it will come true... It won’t. It never will... wrong incentive patterns.

This will be interesting. If the rules imposed aren’t in the interest of public safety, the motive for implementing them will have to be explained by the plaintiff. Will they be able to prove this was inspired by political intentions? Could be an explosive trial.

Cuomo is comfortable making threats. It is a NYC thing.
Actually he is aware that he is partly responsible for the
collapse of New York State and New York City.
So, being a little sawed off punk, he makes the threat then, because he is a chicken shit, he tries to walk it back. That is a Cuomo thing.
Too late for “Fredo’s” brother.
He should be hounded out of office and sent to Uganda.
