EPA Warns California’s 2035 Ban on Gas-Powered Cars Is Possibly Illegal

Environmental Protection Agency Administrator Andrew Wheeler on Monday warned in a letter sent to California Gov. Gavin Newsom (D) that his executive order banning gas-powered vehicles may be unlawful, Reuters reports.

Wheeler wrote that Newsom’s plan “raises serious questions regarding its legality and practicality” and argued that it may cause further issues problems plaguing the state’s electrical grid.

“California’s record of rolling blackouts – unprecedented in size and scope – coupled with recent requests to neighboring states for power begs the question of how you expect to run an electric car fleet that will come with significant increases in electricity demand, when you can’t even keep the lights on today,” the Trump official stated.

Newsom has yet to reply to the EPA.

As of Monday afternoon, approximately 87,500 Pacific Gas and Electric Company customers in California were without power in effort to avoid starting additional wildfires, according to the Los Angeles Times.

Last week, Newsom announced that the state will ban sales of gas-powered vehicles in 2035, calling the order an “audacious” goal that was necessary for the state to operate on 100 percent renewable energy by 2045.

The plan won’t stop people from owning gas-powered cars or selling them on the used car market. But in 2035 it would end the sale of all new such vehicles in the state of nearly 40 million people. That accounts for more than one out of every 10 new cars sold in the U.S.

California would be the first state with such a mandate, while at least 15 other countries have already made similar commitments, including Germany, France, and Norway.

No big deal. Assuming this is still true fifteen years from now, all I have to do is buy a vehicle out of state that has at least 7,500 miles on it and is at least two years old. And given what I usually spend when I buy a used car, this should be no problem.

The automakers should just say eff it and tell CA car buyers good luck charging your electric vehicle when the power is out and to put pressure on the legislators to back off.

I suspect that is the idea. Make people use public transportation which also needs electricity and will be limited or stay home or ride bicycles. For totalitarians it is a good thing to severely restrict mobility of the population.

To prevent fires...why not bury lines? I realize you have to have main lines on towers.

And use NG to it’s full potential. Oh ya...”fracking bad”

And rake the forest floor...that would help. Just sweep the tree huggers attempting a world record aside.

What happened to all the wind turbines in CA? I invested in a Canadian startup at 35 cents a decade and a half ago. Made lots...sold when an American company bought them out at about $2.50.

Exactly correct. Leftist, totalitarians and dictators etc, always want to restrict or limit travel. When people are free to travel independently, like with cars, it makes them harder to control and herd.

These politicians and those in government who come up with all these punitive restrictions don’t have our best interest in mind. It’s all about total control, especially in the big cities. They’re bad news.

By Executive fiat, WA state has banned the use of NG in power plant operations. We will be on solar, wind and hydro only.

This did not go through the legislature but was an edict issued by the governor. I don’t see how that’s legal.

I believe it is illegal too. I mean if one state can ban the sale of ICE vehicles, then Maine could ban the sale of fish, Washington state could ban oranges and other fruit except apples. States would be making heir own rules about what can and can’t be sold.
