Spc. Cesilia Valdovinos was demoted this week after she was caught breaking U.S. Army regulations.
Female members of the Army are required to put their hair in a bun for safety reasons. Cesilia was caught repeatedly wearing her hair down under her hijab, despite warnings, so she was demoted.
Now Valdovinos plans to sue the Army over a violation of her civil rights. She says she is a victim of religious discrimination.
The Army Times reported:
Following a rejected equal opportunity complaint and a demotion in rank, a Muslim soldier who has accused her Fort Carson, Colorado, leadership of religious discrimination is contemplating a federal lawsuit, her attorney confirmed to Army Times on Wednesday.
Spc. Cesilia Valdovinos, who was demoted this week following an unrelated Article 15 investigation, will file a complaint alleging violation of her civil rights either in northern Virginia or Denver, according to Mikey Weinstein, founder of the Military Religious Freedom Foundation.
This is a pattern and practice of anti-Muslim bigotry, prejudice and harassment, he said.
The 26-year-old culinary specialists story first went viral in mid-March, after she filed an EO complaint with her command based on an incident with her command sergeant major at the 704th Transportation Battalion.
The senior noncommissioned officer, believing that Valdovinos was wearing her hair down underneath her hijab ― rather than in a bun, per regulation ― demanded the soldier remove the head covering,
Her hair fell to her shoulders, Valdovinos told Army Times, because she uses the extra fabric in the cap to secure her bun. When she removes it, the bun falls out.
Army sources completely dispute her claims:

NOPE.
She got busted.
The end.
.
She refused to follow regulations, she was warned multiple times, she has no case.
Doesn't sound like a typical Muslim name.
More to the story.
Here MOS is a cook.
After graduation - she refused to handle pork.
She is a waste of air.
Sharia Law doesn’t exist in the Army.
Send the Islamic cult member packing. Boot her from the military if she doesnt renounce Islam.
This is EXACTLY why you do not allow muslims to integrate in any aspect of American life. They insist on us bending to their beliefs and when we try to hold ghem to any type of standard, they cry discrimination. Their beliefs do not align with our constitution in any way, shape, or form. And dont tell me Im islamophobic. That suggests fear. I do not fear them. I reject them and I refuse to bend yo their demands.
I’m not sure and correct me if I’m wrong but I don’t believe that there is any prohibition in the Koran about female hair style below a head covering,
As always, Muslims eventually start demanding special treatment.
Words escape me.
I always thought that once you joined the military, you gave up being an “I” and became a “US”. You did what your told to do. Period. You follow orders.
Guess things have changed.
Or anywhere in the Western World, quite frankly.
She is the PROPERTY of the military. She’s lucky she’s allowed to wear her scarf because it’s not standard military uniform issue.
Her civil rights are limited and there are no civil rigjts to clothing. Otherwise we’d all demand silk undies and Kashmir sweaters...
The army is her mother, father, sister, brother. She could find herself in the brig.
No one has a right to serve in the armed forces.
Not a single one.
I’m guessing there was a Muslim boyfriend somewhere in her past.
Don’t know, don’t care what the Koran says, she was found in violation of US Army regulations.
I’d throw you out under chapter 10 or whatever Division JAG recommended.
How many 2nd+ generation Muslims are there in Spain?
That is the bottom line Manley. The UCMJ does not reflect Shira Law.
Nope, the brig/ confinement facility at fort Carson was dismantled years ago. Sorry if I dont remember were they stay now. Likely the got a contract with the El Paso county sheriff for holding prisoners. The Army still has room confinement monitored by the unit until the hearing for discharge for non compliance to military orders.
