Appeals court rules Trump administration can withhold grants from 'sanctuary cities'

A federal appeals court on Wednesday ruled that the Department of Justice could withhold funding from cities and states that refuse to cooperate with the Trump administration's crackdown on undocumented immigrants.

A three-judge panel on the Second Circuit Court of Appeals overturned a district court judge's ruling that the department lacked the authority to impose immigration-related conditions on certain funding.

A group of seven states and New York City sued the DOJ in 2017 after then-Attorney General Jeff Sessions announced that the agency would start withholding funding from local governments that refused to share information about undocumented immigrants or provide jail access to federal authorities investigating inmates' immigration status.

The states challenging the policy are New York, Connecticut, New Jersey, Rhode Island, Washington, Massachusetts and Virginia.

This is a good result in isolation but underscores why Federal “grants” in general are a bad thing.

They always come with strings attached.

It also ‘underscores’ why we need four more years for Trump to get the work done that's been tied up in the courts! As these are settled he's free to implement the course he wants to take .

The decision by the three judge panel of the 2nd U.S. Circuit Court of Appeals [Ralph Winter/Reagan, José Cabranes/Clinton and Reena Raggi/Dubya] overturned a lower court’s decision [0bama judge Edgardo Ramos, SD-New York] ordering the administration to release funding to New York City and 7 states — New York, Connecticut, New Jersey, Washington, Massachusetts, Virginia and Rhode Island.

In the last 2 years, federal appeals courts in Chicago [Seventh Circuit], Philadelphia [Third Circuit] and San Francisco [Ninth Circuit] have ruled against the Trump administration by upholding lower-court injunctions placed on the enforcement of some or all of the challenged conditions.

It is to laugh. Reena Raggi writes the decision for our side.

This sets up a Supreme Court fight.
