The Supreme Court on Monday rejected efforts by President Donald Trump and his allies to get the court to quickly consider challenges. The move effectively shut the door on the president’s legal strategy to stop the steal. The court released an order in the morning denying expedited consideration to suits filed by Trump’s campaign challenging election procedures in Pennsylvania and Wisconsin. It similarly denied requests from L. Lin Wood and Sidney Powell to expedite challenges to the elections in Michigan and Georgia, as well as other suits filed by Trump supporters. The action by the court was widely expected and...

In a slew of important cases before the Supreme Court, Chief Justice John Roberts “has engaged in strategic maneuvering, observed Adrian Vermeule and Varad Mehta at The Washington Post: Roberts' goal appears to be to preserve what he takes to be the legitimacy of the Supreme Court, by disproving any suspicion that the justices vote ideologically or otherwise engage in political behavior.” The problem: “Because it is so clear that he is crafting opinions with this end in mind, the chief justice defeats his own aims.” His effective rewriting of the ObamaCare law in 2012 was the most notorious example....

These past few weeks the dysfunction of the Supreme Court has come to a head. The Court, led by Chief John Roberts, has removed itself from getting involved in the 2020 election. Something’s not right. The manner in which Chief Justice Roberts runs the Supreme Court is a travesty. It is corrupt. He doesn’t uphold the rule of law, he breaks it. A week ago the Supreme Court threw out the Texas case which more than 20 states joined in support. This was the first case on the 2020 election based on its merits. It was shocking that the three...

At least four times now Justice John Roberts has betrayed the conservatives. Further he has twisted the law and written decisions that were legal contortions inconsistent with his legal ability and history. What has been going on? What could have motivated him to betray his country and his legal integrity like that? It has been suggested that Roberts is secretly homosexual, and he did pro-bono work for gay activists back in 1996, but the stigma attached to that has effectively been removed by societal changes over the decades. He appears to be happily married in the normal sense. It has...
  • Don't Apologize For Blurting Out The Truth, Justice Ginsburg

Many years ago, journalist Michael Kinsley secured a place in our history when he observed that “a faux pas is when you blurt out the truth in Washington.” Last Friday, Supreme Court Justice Ruth Bader Ginsburg committed a faux pas in a New York Times interview, blurting out the truth that she is intensely partisan and decides major cases on ideological grounds. Federal judges are supposed to keep out of the political mud, but Justice Ginsburg opined that Donald Trump would be a national disaster. “I can’t imagine what the country would be with Donald Trump as our president,” she...

Donald Trump retaliated against Supreme Court Justice Ruth Bader Ginsburg for disparaging comments she's made about him in three separate interviews. In a 1 a.m. tweet Wednesday, he said she "has embarrassed all by making very dumb political statements about me. Her mind is shot - resign!" Trump had already hit back once Tuesday, in an interview with The New York Times, in which he said it was "highly inappropriate that a United States Supreme Court judge gets involved in a political campaign, frankly." He said her words were "a disgrace to the court," and he called on her to...
