Prosecutors are asking a judge to bar a Capitol rioter from arguing that former President Donald Trump authorized him to attack the Capitol on January 6.
Aaron Mostofsky, the son of a New York City judge, was photographed inside the Capitol wearing fur pelts, what appeared to be a police officer's bullet-proof vest and carrying a police officers' riot shield. Mostofsky's trial is set to begin in January and prosecutors are hoping to block him from using the "blame Trump" defense ...

The prosecutors just skunked all their other cases and the congressional commission’s investigation of Trump and his people re Jan. 6th riot planning.

The defendant should just claim that Pres. Trump issued the authorization with a dog whistle.

My defense would be that all the race riots 2019 normalized and sanctioned behavior far worst than the mere visitors and vacationers seeing the building just as going to a zoo. That it was sanctioned by the protection provided Democratic rioters nationwide.
This is the completely worthless defense you get if you hire an expensive politically Hard Left attorney.
Scooter Libby hired the best Black defense attorney in Washington D.C.
His closing argument focused on one utterly meaningless question: "Why are George Bush and Dick Cheney not on trial here?"
The jury - LOL - was so moved, they convicted Scooter on their first straw vote, but politely stalled long enough to get a free lunch before informing the judge.
Bottom Line...
If you got arrested for the Capitol Occupation, you need an attorney who voted for Trump and understands EXACTLY what your political motivation was.
Only takes one vote for you to potentially walk away as a free man.
Your defense must find that one juror and give him the compelling arguments and the courage to stand alone in your defense in the Jury Room.
Precedent is a beautiful thing.

i thought the whole purpose of this witch hunt was to blame Trump, and now denying that as a defense?

Not to mention the fact that in most states, he should have been arrested for wearing that armor saying “Police” on it (impersonation of a peace officer).
